Actually overstaying in another country without proper documents is a crime, hence that person is a criminal. Nothing as good as having complete paper. |

Golan007:It's actually a criminal act and offense to enter and reside in any nation without documentation and authorisation. Except the laws and rules have magically changed overnight. Imagine if such a person is caught in places like Saudi Arabia or China... Will there even be room for grammar or courtesy?!! That's akin to a stranger or outsider coming into a community in the pre-colonial era, and blending with others for a while... How do you think he would be treated when found out?! As extreme as the deportees were treated, I sense the U.S officers didn't want to risk violence and suicide during the flight. |

Some even got violent in-flight and if they were not restrained would have caused the plane to crash. The Officials have little to no choice in this matter...! Handcuffing illegals during deportation is not something new. |

Restraining these people is not necessarily because they are even viewed as criminals. They are restrained for their own safety and more importantly, the safety of the flight officials and crew members. This is not something new or strange. |

Golan007:According to the American law, residing in their country illegally is a CRIMINAL OFFENSE. Criminals don't have any right. It can be a misdemeanor or felony. Depending on the case. Moreso, ICEs primary target is violent criminals/people that ran away from countries with prior criminal records aka Harderned Criminals in Nigeria. When others see it, it will serve as a deterrent. Some countries have laws. At least, try and listen to the WH press secretary. Smart woman. The law prohibiting “improper entry” in the U.S. by noncitizens is found in 8 U.S. Code § 1325 and the Immigration and Nationality Act (INA). This legal code stipulates a fine or imprisonment for any migrant who “(1) enters or attempts to enter the United States at any time or place other than as designated by immigration officers, or (2) eludes examination or inspection by immigration officers, or (3) attempts to enter or obtains entry to the United States by a willfully false or misleading representation or the willful concealment of a material fact.” Dude said it's a civil issue. SoliBayNG:No. The act of being present in the United States in violation of the immigration laws is not, standing alone, a crime. While federal immigration law does criminalize some actions that may be related to undocumented presence in the United States, undocumented presence alone is not a violation of federal criminal law. Crimes for Which Migrants are Prosecuted Physical presence in the United States without proper authorization is a civil violation, rather than a criminal offense. This means that the Department of Homeland Security (DHS) can place a person in removal (deportation) proceedings and can require payment of a fine, but the federal government cannot charge the person with a criminal offense unless they have previously been ordered deported and reentered in violation of that deportation order. Likewise, a person who enters the United States on a valid visa and stays longer than permitted may be put in removal proceedings but cannot face federal criminal charges based solely on this civil infraction.

If he skips school and engages in business instead, he hasn't committed a criminal act. If he overstays his visa, he hasn't committed a criminal act.
