This appeal SC/CV/1071/ 2024: GOV of Rivers State v Rivers State House of Assembly & Ors that came up today at the Supreme Court has become purely academic.

The case leading to this appeal was before James Omotosho as SUIT NO. FHC/ABJ/CS/1613/2023

It was filed on the 29th day of November 2023.

SUIT NO. FHC/ABJ/CS/1613/2023 pertains to the 2024 budget, which is no longer alive, the monies appropriated therein having been judiciously spent for the benefit of the good people of Rivers State

The 2024 budget became spent on the 31st December of 2024 fiscal year

The appeal is of no useful purpose in this year 2025, which has its own budget.

The only reasonable thing left to do in the circumstances was to withdraw the appeal and have it dismissed.

It would be most unwise to belabour the Honourable Court with academic appeals without any practical or utilitarian value.

It is important to note that after Suit No. FHC/ABJ/CS/1613/2023 was filed on 29th November 2023, Martin Chike and his 26 friends defected from PDP to APC on the 11th Day of December, 2023. Their seats in the Rivers State House of Assembly became vacant.

This appeal that was withdrawn today has nothing to do with the seats of Martin Chike Amaewhule and his 26 friends in the Rivers State House of Assembly. The members of the public should not be taken in by the misleading propaganda by Martin Chike Amaewhule and his 26 friends.

Can you all stop lying for once. Go and read the judgement and stop distorting facts. Clear directives were given by the judge recognizing Martin as the authentic speaker of the Rivers state house of assembly.

WIKE LOSES OUT AS PDP ACCEPT COURT RULING, RESTORES HIS EXCELLENCY Sir Siminalayi Fubara EXCO IN RIVERS STATE. CONGRATULATIONS TO YOU SIR .

The National Working Committee (NWC) of the Peoples Democratic Party (PDP) has acknowledged and accepted the judgment of the Rivers State High Court, which nullified the party's Ward, Local Government, and State Congresses conducted on July 27, August 10, and August 31, 2024, respectively.

In compliance with the court's decision delivered on Monday, January 13, 2025,
the NWC has reinstated the Hon Nname Robinson Ewor -led Rivers State Executive to oversee the affairs of the PDP in the state, under the party's constitution.

The NWC commended the court's decision, emphasizing the PDP's commitment to transparency, internal democracy, and adherence to the rule of law in its operations.

A statement signed by the PDP national publicity secretary, Hon. Debo Ologunagba read in parts:

The NWC charges the Ewor-led Rivers State Executive to work hard to further unite the Party in the State so that the people of Rivers State can continue to enjoy the massive dividends of democracy as being delivered by our performing governor, Sir. Siminalayi Fubara, in line with the manifesto and policy thrust of the PDP.

The NWC commends all members of the PDP in Rivers State for their steadfastness and unshaken belief in the ideals of the Party as a truly democratic and all-inclusive Party guided only by the collective Will, yearning and aspiration of the people."

Why not let the court say that themselves? As it is now Sim Fabura is trying to build something on nothing. As long as he doesn't resubmit the 2024 budget and its expenditures first and hope the house of Assembly approves the budget and he defends the expenditures before relevant house committees and then represent the 2025 budget and defend it he can not last as Governor up to2 weeks after the next supreme court judgement.

Well let's watch as the matter plays out.
