S’Court Verdict: Crisis Looms In Rivers As Ex-LG Chairmen Vow To Resume Office Monday

Following the verdicts of the Supreme Court on the political crisis in Rivers State, former chairmen of the 21, out of 23 local government area councils in the state, have vowed to resume office on Monday, March 3, 2025.

In a viral video on social media, the former chairman of Ikwerre local government area of the state, Dr. Samuel Nwanosike, said their decision to return to office was based on the extension of their tenure by the legally recognised Rt. Hon Martins Amaewhule-led legislature.

Nwanosike said: My name is Dr. Nwanosike Samuel, chairman of Ikwerre local government of Rivers State. By the judgement of the Supreme Court, I am still the chairman of the LGA because the Rivers State House of Assembly extended our tenure by six months.”

Efforts by our Correspondent to speak with some of the former LGA chairmen proved abortive as they failed to respond to calls and WhatsApp messages sent to them.

Recall that the Amaewhule-led House of Assembly, had in April 2024 extended the tenure the former LGA Chairmen for another six months based on Section 9(2) of the Rivers State Local Government Law 2024.

The law, which Governor Siminalayi Fubara refused to assent to, but vetoed by the House, empowered the state legislature to extend the tenure of the last democratically elected chairmen for six months pending when election shall be conducted for a new government to takeover the administration of LGA councils.

Also, recall the Fubara had on June 19, 2024, appointed caretaker committees to oversee the affairs of the LGAs following the expiration of their initial tenure in office.

The caretaker committees oversaw the affairs of the LGA councils until October 7, 2024, when the governor swore-in new elected chairmen and their councillors for the LGAs.

The law is sacrosanct, any law that is inconsistent with the laws of the federation is null and void and of no effect section1(3) of the 1999 constitution as amended . There is no tenure elongation for the executive arm whether its lga, state or federation.

Oga nobody is following the laws again in Rivers State, the same way the governor conducted the LG election without register from INEC as our laws provide, the ex chairmen will resume on Monday, the supreme court will decide whether there is tenure elongation or not when he takes the matter to the supreme court.

Oga nobody is following the laws again in Rivers State, the same way the governor conducted the LG election without register from INEC as our laws provide, the supreme will decide whether there is tenure elongation or not when he takes the matter to the supreme court.
The LGA chairmen have handed over, another elections will be conducted, there is no tenure elongation for the executives

Who is he to direct the Head of Local Government Administration to run the affairs of a local government? Does he have such power?

Section 135(3) empowers the legislative arm to extend the tenure of office of the executive in case of peculiar circumstances like that of Rivers state. So, it is the responsibility of the Rivers state house of assembly to act to ensure there is not gap at the local government level and not that of the governor. The governor has no such power under the law to direct civil servants to take over the local government administration.

This is not true.
It gives power to only the President to do that in TIMES OF WAR.
Is Rivers State at war?

That section only talks about the President and the NASS. You don't add to the CFRN what is not.

Okay. Tell us the section of the constitution that gives the governor the power to direct some unelected civil servants to take over the administration of the local councils.
There is no section of the Constitution that forbids it either.
That law is inconsistent with Court Judgements.

I will answer these questions in 2 ways:-
1. Justice Omotosho of the FHC dismissed this tenure elongation for the fact that it has become academic. They do not have the locus standi because their tenures had ended.

2. A Rivers High Court also struck out the amended law because it was inconsistent with another law, insisting that their tenures had expired.
They appealed and the judgement was direct, the suit lacked merit.
Note however that the Supreme Court didn't deal with the reinstatement or the law.
