MrHighSea:Not a crime unless she financially benefited fraudulently or someone got harmed. False claimsDoesn't apply in this case. Lying is not a crime unless it is accompanied by financial fraud or benefits. She could make the company to lose real buyersThis isn't a crime as the law doesn't operate on assumptions and suppositions. But if the company can show they have lost money, then they can be compensated from her daily daily hawking profits! |

erico2k2:False claim is lying about an item usually a product, a qualification in order to gain financial advantage. In fact, the only person who can claim civil damages in this case is the church. Again, the police shouldn't be detaining people based on civil complaints. This is no different than going on Channels TV as a car expert(who actually never owns no car) and saying Bentley cars are most fuel efficient. If people call out the lie, then it will be idiotic for Bentley to jump into the issue. Only Channels could reasonably sue in such case. I am not saying the Real Estate company in this case can't sue but they will lose the case and I am sure their lawyers would have told them the same thing. This is why they are using the police to illegally punish the woman like many Nigerians like to do. |

Xisnin:The fact that he made this claim inside a house that belongs to an Estate agent, and also claimed she has paid the owner 200M is the issue. She As you can see, the claim is tied to a church. This is an attempt to dupe people into believing it was a miracle. |

erico2k2:It doesn't matter where the statement is made. It remains a non-criminal act. As you can see, the claim is tied to a church.Even if we accept this, it is is not a crime. No financial benefit/loss, no crime! |

Xisnin: IM sure you are wise to know that the bolded is decided by the Judge not me nor you, the bolded is the reason to go to court, the rest of us can just speculate . |

erico2k2:You are missing the point. Judges don't make law. If you take someone to court over land ownership for example. Does that mean the defendant is a criminal? Regardless of the verdict, whether you win or lose the case. Judge will decide Mr. A is the rightful owner and that is the end of it. No sentence, no punishment. No crime was committed in such a case. Such cases are collectively referred to as civil cases. |

Xisnin:Where did I say the Judge makes a law? The judge determines if an offence was committed, that was what my last statement meant. How does that amount to making a LAW? Determination of weather a crime was committed or not is the job of the judge as this is done through interpretation of the law and guess who.s job that is? |
