After this intervention, Fabura was misled, that he was democratically elected just like the president and that Tinubu had no power to direct him to agree to any resolution. Now, the democratically elected Tinubu has suspended the democratically elected Fubara. Their power are far apart. I pray they reconcile before September. |

If you choose to be loyal to a godfather to the extend of needing his help for election, then the problem is all yours to deal with and remain loyal instead of being a USER. LEGAL OPINION ON THE PROPRIETY OF THE DECLARATION OF A STATE OF EMERGENCY IN RIVERS STATE PURSUANT TO SECTION 305 OF THE CONSTITUTION --- 1. INTRODUCTION This legal opinion is issued in light of the declaration of a state of emergency in Rivers State by the President of the Federal Republic of Nigeria. The opinion seeks to determine whether the declaration meets the legal threshold as provided under Section 305 of the 1999 Constitution of the Federal Republic of Nigeria (as amended). --- 2. STATEMENT OF FACTS The following material facts are considered relevant: - An ongoing political conflict between the Governor of Rivers State and members of the State House of Assembly. - The demolition of the Rivers State House of Assembly complex under the directive of the State Government, allegedly on the grounds of structural damage. - Reports of pipeline bombings and destruction of critical oil infrastructure in parts of Rivers State. - Claims of threats to public safety and breakdown of law and order arising from the above developments. --- 3. LEGAL ANALYSIS (a) Threshold of “Actual Breakdown” The Constitution requires actual, not speculative, breakdown of public order and safety. In this case: - The demolition of the Assembly complex, though politically controversial, can be argued to be a governance issue — however, it becomes constitutionally significant if it leads to an institutional vacuum or violent confrontation. - Bombing and destruction of oil pipelines, if confirmed to be widespread and disruptive to civil order and security, could qualify as a serious threat to public safety, and meet the constitutional threshold. (b) Necessity of “Extraordinary Measures” If conventional law enforcement mechanisms are overwhelmed, and the situation endangers national security, energy infrastructure, or civil peace, then extraordinary measures (like a state of emergency) may be justified under Section 305(3)(c). (c) Doctrine of Federalism and Subsidiarity Any state of emergency must respect the autonomy of states within the Nigerian federation. A premature or politically motivated emergency declaration could undermine constitutional democracy, except where public safety cannot be otherwise guaranteed. --- 5. CONCLUSION - Based on the totality of facts, especially if verifiable evidence confirms that civil order has collapsed or is collapsing due to bombings, public unrest, or institutional paralysis, the declaration of a state of emergency may be legally sustainable under Section 305(3)(c). - However, if such breakdowns are localized, containable by civil authorities, or politically orchestrated, then the declaration risks constitutional overreach. --- 6. RECOMMENDATION It is advised that: - The National Assembly should thoroughly vet the factual basis before approving the emergency proclamation. - The Federal Government must transparently communicate the scale and nature of threats to justify its action. - Civil society and courts should remain vigilant to prevent misuse of constitutional emergency powers for partisan or authoritarian ends. |
