The Supreme Court has struck out a suit by the 36 states’ governments and the Nigeria Governors’ Forum (NGF) challenging the Federal Government’s application of recovered looted funds.

Delivering judgment, a seven-member panel unanimously held that the suit was wrongly instituted before the apex court.

In the lead judgment, prepared by Justice Chidiebere Uwa, but read by Justice Mohammed Idris, the apex court held that the plaintiffs wrongly invoked its jurisdiction.

The apex court held that the subject matter of the suit was within the jurisdiction of the Federal High Court.

The plaintiffs had claimed that “between 2015 and 2021 when the suit was filed, the FG has secured both international and municipal forfeiture, recovery and repatriation of “stolen assets” in the sum of NI,836,906,543,658.73, about 167 properties, 450 cars, 300 trucks and cargoes, and 20,000,000 barrels of crude oil worth over N450 million,” which it allegedly failed to remit as required by the Constitution.

They alleged that instead of paying the cash into the Federation Account, the FG illegally diverted it into the Consolidated Revenue Accounts (CRA) and other accounts not recognised by the Nigerian Constitution.

The states argued that the CRA is the account into which FG’s share from the Federation Account, other federal earnings, and funds belonging to specific state governments are paid.

They added that other federal earnings payable to the CRAs include receipts from federal government licenses and land revenue, administrative fees, earnings and sales, rent of government property, interests from federal government investments, repayments from state governments, Personal Income Tax of Armed Forces, and others.

The plaintiffs stated that by establishing the Asset Recovery Account and Interim Forfeiture Recovery Account, into which revenue from recovered assets was to be paid, the Asset Recovery Regulation contradicts the provisions of the Constitution.

They noted that since 2015, “numerous recoveries of illegally acquired assets have been secured through anti-corruption and law enforcement agencies,” including the Economic and Financial Crimes Commission (EFCC), Independent Corrupt Practices and Other Related Offences Commission (ICPC), the Nigerian Police Force and the Office of the Attorney General of the Federation.

Citing sections 162(1), 162 (10), and 80 of the Constitution and section 2 of the Finance (Control and Management) Act, 1958, the plaintiffs argued that recovered funds qualify as revenue payable to the Federation Account instead of the Consolidated Revenue Account of the Federal Government.

They stated that it is “unconstitutional to remit or divert revenue payable into the Federation Account to the Consolidated Revenue Account of the Federal Government or any other account whatsoever, or to apply the said revenue to any other purpose,” the plaintiffs argued.

The plaintiffs prayed the court to, among others, declare, “that by the provisions of Section 162(1) and Section 162(10) of the Constitution of all income, returns, proceeds or receipts howsoever described derived from confiscated, forfeited and/or recovered assets constitute revenue of the federal republic of Nigeria, must be remitted to the Federation Account for the collective benefit of the federal, state and local governments”.

They urged the court to issue a d order compelling the remittance of N1.8 trillion (cash) and N450 billion (non-cash) in recovered loot since 2015 into the federation account.

The plaintiffs also prayed the court to compel the defendants to give a detailed account of the recovered assets that are not remitted into the Federation Account by the President, as well as all the relevant officials and agencies of government.

They also want the Supreme Court to compel the FG, through the Revenue Mobilisation and Fiscal Commission (RMFAC), to design the modalities for distributing recovered assets among the federating units.

The constitution couldnt catch the looters so judiciary should leave the loot alone.

The source of the fraudulent money should take priority. Therefore, governors should take the case to the federal high court and work out a definite sharing formula between the FG and affected states.

If James Ibori steals #30 billion from Delta State, the EFCC recovers #25 billion, then the FG should take 35%, Delta State takes 50% and the EFCC takes 15% for legal expenses, running cost, salaries, etc. The EFCC should be considered a parastatal.

This demand makes me laughed!

For example, somebody is finger in Kano State, that he looted money and collected kick-back, is shielded by political god-son and associates and refused to return the money because of political affiliation (sins are forgiven according to them) on ther hand somebody in Edo looted and EFCC charge the person to court and wone the case and the money refunded.

Now what the governors are saying is that the money recoverd from Edo should be lodged into account where it would be shared with Kano State!

These are the same governors that would shield/hide information on how the former governor looted money and wants the ones that were recovered to be shared with them for Aluta-Continual

How many Governors has come to say the former governor whom they're from same political party mismanaged funds that he should be investigated by providing financial documents to the appropriate authorities?

Where that pained me most was where the states governments made mention of Local Govt as if they are taking good care of Local Govt.
They took FG to court on the same thing they are doing to Local Govt.... God bless those judges for striking out that case.

The Governors were hoping to get their share of the recovered Abacha loots that the USA has been returning since forever, unknown to them that all those millions of dollars that the USA has been claiming to return to Nigerian government were audio money. It never existed in the first place.

Any sensible Nigerian should know that Abacha was not that dumb to not recognize the West as an enemy of Africa. During Abacha's regime, Nigeria was sanctioned heavily by the West just like the Russia of today, for daring to switch to military rule. They refused to buy our Crude oil and other exports, and they were after Abacha just like they are after the Burkina Faso leader today.
Won't a reasonable person now ask for a sensible explanation of why Abacha should then decide to stash his "loots" in the USA under such hostile treatments?

The reason the USA kept announcing newly discovered Abacha loots and the Nigerian government kept acknowledging the receipt of such audio money is because it is a mutually beneficial propaganda that killed 3 birds with a single stone:

1) It enforces the false notion that the USA is a Saint that wants to help Nigeria progress by helping to actively search their bank accounts for moneys looted by Nigerian leaders, and then returning such moneys to Nigeria when found,
2) It brainwashes Nigerians into detesting military rule since all the looted money that the USA has been recovering just happened to be from a military leader who is no longer alive (to tell their own side of the story),
3) Now that Nigerians believe the USA are Saints(point 1 above), and detest military rule(point 2 above), we will therefore have no choice than to accept the democracy that the USA and their western minions are shoving down our throat; a democracy that is simply the West installing a "Warrant Chief" cum President whose real duty is to govern Nigeria on behalf of Paris and London.

If Peter Obi steals #30 billion from Anambra State, the EFCC recovers #25 billion, then the FG should take 35%, Anambra State takes 50% and the EFCC takes 15% for legal expenses, running cost, salaries, etc. The EFCC should be considered a parastatal.

Then Delta state under Ibori successor Uduagha will re-steal the 50% plus additional new loot.

If you ask me, recovered loots shouldn't be returned in monetary forms, instead it should be used to directly fund projects, roads, hospitals etc.
