I hate seeing this case being discussed. If senator Natasha has no proof to back up her claims, then the case should not have been mentioned in the first place. She is educated for a reason.
But if she has evidence and people are suppressing her, then I fear for the future of this country.

She can not be restored if her advice is not an order. That is why I suggested that the law should outrightly forbid the suspension from Senate. Suspension should be from Senate committees but not from the democratic institutional representation. I will even suggest even suspension of allowances but not suspension from Senate. It's not democratic in my opinion.

the Thai prime minister was just suspended 3 days ago, & been demoted to the culture ministry, one cannot bring the hollow chamber into disrepute & expects to go scot free with a pat on the back.

She should keep her & Akpabio’s alleged promiscuity out of senate business.

She deserved the suspension.

“ ABUJA– The Federal High Court sitting in Abuja has ordered the Senate to reinstate the suspended lawmaker representing Kogi Central, Senator Natasha Akpoti-Uduaghan.

The court, in a judgement that was delivered by Justice Binta Nyako, described as “excessive”, the six-month suspension that was slammed on the lawmaker by the Senate.

It faulted the provision of Chapter 8 of the Senate Standing Rules as well as section 14 of the Legislative Houses, Powers & Privileges Act, declaring both as overreaching.

The court stressed that the two legislations failed to specify the maximum period that a serving lawmaker could be suspended from office.

According to the court, since lawmakers have a total of 181 days to sit in every legislative circle, the six-month suspension handed to Senator Akpoti-Uduaghan was akin to pushing her away from her responsibilities to her constituents for about 180 days.

It held that though the Senate has the power to punish any of its members who err, such sanction must not be excessive to deprive the constituents of their right to be represented.

Nevertheless, the court held that the Senate President, Godswill Akpabio, was not wrong to have denied the plaintiff who was not on the official seat that was allotted to her, the opportunity to speak during plenary.

Justice Nyako equally dismissed Akpabio’s contention that the court lacked the jurisdiction to entertain the suit which he said bordered on an internal affair of the Senate.

Please sir, where did you manufacture the word “advise” from? The body of the report carried “advise” and reporters from several news agencies carried the word “ordered”? Between you and the reporters, who was right inside the court? Who got first hand information between you and them?

By the way, did you not read in previously decided cases that the suspension contravened senate rules? Did you read other decided cases?

It is not a court order but opinion. The Senate can appeal or ignore it outrightly.

The problem is that in democratic setting, Senate should not have the right in the first place. You can suspend her from committees but not from the Senate. This has to stop.

You didn't know what you're saying.
She delivered her judgement on the matter. The judgement is that the Senate should recall Natasha. That was not an opinion.

After delivering her judgement, she then advised Senate to review their rules on sanctions. The advise does not mean that they should go and review Natasha's sanction.
She found a 6 months sanction and unlawful and is now advising them to go and review such rule in the Senate so that they won't try such undemocratic things again.

Natasha did not sue for mediation. She approached the court for lawful decision and judgement. So Nyako can't be giving advice/suggestions in a case where a legal decision/rule is required.

The judge was not aware that Senate rules was above the constitution abi, dey play with Senate rules in nija

You made a deep analysis - as the Judge has not advanced the reason on Why and What Natasha Did to the Senate President,in the first place but the Judge has now find it convenient to tell the Red Chamber - that they should recall her,while the real wicked intension of Natasha is Not Analysed to the Public!

Yes you are right. If the Senate had stepped out of its own code of conduct to sanction Madam Natasha, the court can rule them out of order because there is no legal basis for that.

But if the regulation is duly agreed and documented in the Senate's stating rules or code of conduct, it is binding on all legislators and the court cannot rule against it.

The principle of separation of powers is duly enshrined in the Nigerian constitution and by its provision, the legislature, just like the judiciary and the Executive arms of government, is self regulating.
