Hello Nairalanders, I need your advice urgently. I rented a self-contained apartment in Lagos, and my rent is valid until the end of October this year. Just recently, I was informed that the landlord has sold the house. Now here’s what happened: • They refunded half of my rent (without my prior agreement), • And issued me a 3-month notice to vacate. I never agreed to terminate my tenancy early or to receive a refund — they just gave me the money and served the notice. I feel like I’m being indirectly forced out before the agreed expiration date of my rent. Please, I want to know: 1. Is this legal under Lagos tenancy law? 2. Can they harass or pressure me out of the house since it’s now sold? 3. What steps can I take if I want to stay until my rent expires in October? I’ve heard that once rent is paid and acknowledged, even a new landlord must honour the agreement. Is this true? Please, lawyers and those familiar with Lagos tenancy law, I’d appreciate your input. I don’t want to be bullied or treated unfairly and also 3 months is too short for me Thanks in advance! |

The notice was given to me April 24 and to expire this month July 24. I haven’t been able to raise complete money for a new apartment given the whole agency and agreement nonsense. Plus I just moved into the house November 2023 and renewed my rent last year December. All of this is really shocking and unplanned. Please lawyers assist on the way out. |

If your rent is not due then you will not leave the house..If any one tries rubbish just get a lawyer and sue for better money..Your rent must expire before you leave the house..No Dey fear oo,just get a better lawyer and not all lawyers are stubborn so you look for a stubborn lawyer..I hope you never chop the money? |

The new owner becomes your landlord until your rent expires as long as you have your evidence of rent payment to the former owner intact! Modified But now that you’ve been refunded and you willingly accepted the refund, your tenancy agreement has ended as long as they gave you ample time to search for another accommodation after your refund (they can’t refund you today and ask you to pack out tomorrow) So they refunded you and gave you 3 months to move out and you are now complaining. You can’t eat your cake and still keep it You shouldn’t have agreed to the refund, you should have waited till your rent expires before you agree to move out because that is the official time your tenancy agreement ceases, but by willingly collecting a refund, you shot yourself in the foot |

This is hard oooo.. The thing is legally, the landlord has no obligation to tell you if he wants to sell his house or not..... Good thing is that he has given you quit notice.. But u sef, you are not proactive at all...... They gave u since April and it is now you are just bringing it to seek for advice..... |

I don’t think the landlord can displace you. The previous owner should have mentioned your active tenancy to him. Lawyers in this domain will have better answers. |

You have the right to remain there until your rent expires. The rent they refunded to you, how did that happened? You consented to it? They forced the cash into your hands or you voluntarily gave them your account number? Cheny00:He is bluffing. |

Your rent expires in October. This is July and you have been given three months notice to quit (August, September, October). They returned part of your rent, the money is with you meaning acceptance. Please start looking for another house. They might give you a further three months notice if you do not leave by October. Please, (especially if you leave with your family there) look for another house biko. |

Cheny00:Army can’t usurp the power of the court. He’s just fooling around. If he does that, you don hammer. You will make a claim in court he won’t be able to come out of. |

The notice of eviction should be at least six months so he can't deplace you before that time except on some serious and deadly charges which isn't the case here Just get a lawyer and stand your ground if he threatens You can even sue for damages and legal fee. The threat of using army would even make the case more favorable to you. You can sue for harassment and intimidation as well. The only hassle I see here is the collection of your rent balance which denotes your acceptance or approval of the eviction. You shouldn't have collected the money in the first place. |

Cheny00:The law will definitely recognizes 3 month quit notice as enough time although am not saying it's the final Your rent is not due for renewal and they already refunded half of your yearly rent which is a fair deal The only issue is the total package thing and this has why we need this agency work to be highly regulated I will advise you look for another house because it's not worth the stress to drag it further with the new owner although you can negotiate with him and see if he will retain you as his tenant |

The purchase/sales of the property must have been completed with the status of the property in sight. In buying the property, the contract should state the tenancy status of all occupants. The buyer should have that information at the point of sale while the seller has the right to disclose such. In one word, you stay was part of the sales terms and the new owner does.not have the legal powers to displace you. I am not a lawyer and do encourage you get one. |

advocatejare:Mr advocate,he has collected a balance refund and that means he has agreed to vacate,automatically his rent expires up to the time of the refund he collected.maybe he has about 6 months notice free and another 3months which will be paid for,if you like go court,for any other days or months you stay in the house after then you must pay untill the court come and evacuate you since you refuse to vacate. Don’t let anyone mislead you,don’t waste your resources ,last last you will leave the house and no law will allow you to occupy another persons property until anytime you like.if you have the means,just vacate honorably,you can still negotiate some time more with the new owner if your grace period expires but anyone telling you to go to court is a mugu. |

There shouldn't be any issues with the new buyer, once you show your rent receipt, you are covered by law to stay the remainder of your rent. |

Hmmmmm. If your previous landlord issued you with rent receipt, then you will stay till your unexpired rent elapses in October. If he threatens to evict you with army, then thank your stars because you’re soon going to be rich by forceful eviction. Again, write a letter to the issuer of that notice to quit informing him of your desire to stay till your rent expires. Then request for an account number to refund the money he/she paid to you |

Why don't you move on by looking for another house. Don't waste your energy on pursuing cases. They have given you some refund and Quit Notice already. Follow peace with people. |

Such has always been happening and still happening, the landlord might sell his house but the room should remain valid until the rent expired and even extra years should be given to you free should the new landlord doesn't want tenants to stay... |

I am not a lawyer.. Breach of contract: If the tenant violates the tenancy agreement (e.g., non-payment of rent, property damage), the landlord may have grounds for immediate eviction, even if the rent has not expired. Legal recourse: If a landlord unlawfully evicts a tenant before the notice period expires, the tenant can seek legal remedies. Go and get yourself a good lawyer...you have won the case already bro!!! |
