Well, based on my knowledge

From my lawyer actually, you can rent a house today, make next week, landlord issue you 6month notice, as long as you have received the notice, you start looking for alternatives, you have been refunded and still given free 3 months to stay, even in court, you will pay for that 3 months and subsequent months till you pack out, in law, when you rent, just have it at your mind that you have 6months to stay, for organization which is paying for the apartment you live in based on say you are working and it comes with apartment, you have 3 months notice already

This contention is about tenancy and not lease, because with lease,the agreement binds you and the new owner and you will leave when the agreement expires or when you want to as long as the agreement still remains.....


My brother, ask them for more time, like additional 3months with monetary offer

The notice was given to me April 24 and to expire this month July 24. I haven’t been able to raise complete money for a new apartment given the whole agency and agreement nonsense. Plus I just moved into the house November 2023 and renewed my rent last year December. All of this is really shocking and unplanned. Please lawyers assist on the way out.

My own so called useless landlord sold his too when my rent was not expired and could not give me my money which I use to fix tiles and other things in the apartment, he could not even care to come over and introduce the new buyer to me he sent his co-419 so called caretaker and the day he sold his house someone else told me and i rush and called the man he did not pick later on he was flashing me i look at it and smile, and concluded that poverty is already written all over the man and his so called caretaker so I look at it as a distraction to my life and they really wanted to frustrate me but the God I served told me to forget about the money and keep moving forward so I did.

You're even lucky they refund half of the money to you don't waste your time for lawyers in that three months they gave you all you need to do is starting looking for money to get another place else this will distract your plans , if God really want to bless someone these are the ways he do come so don't mind your landlord, be focus and keep pushing on something good will come your way.

That's where the issue is, he shouldn't have collected the remaining balance but the court is there to interpret that part.

1. Return the money to the landlord's account. You cannot hold on to the 50% refund if you choose to pursue legal actions against the landlord.

2. Having returned the 50%, your rent will expire in October 2025 and the 3 months quit notice still stands (as you have even now been notified earlier).

3. Quit notice does not mean extension of rent. At most, you will be given another 2 weeks to sort yourself out after the expiration of your rent in October.

4. The landlord has no right to forcefully eject you from his apartment whether with army, police, DSS, navy or even Amotekun. Only a court order can evict you and this eviction must be done after you have been properly served, given time as stipulated by the order, and exhausted the several warnings by the court. Again, only a court bailiff accompanied by a police officer can execute an eviction order.

Did you read and understand his post before responding?

OP, an agreement can be amended. by your acceptance of the returned rent, you are no longer a yearly tenant. Dialogue with them on the way forward! They could have served you 6 months' notice in April and it would have coincided with the expiration of your rent.

Abi o; don't be mislead by some people here saying you get right to sue your new landlord. You received and accepted 3 months compensation. You should have rejected it or demand for higher offer but it's too late to fight for your right don't be deceived. Just beg the new landlord because you've already compromised your right.

Disregard all those telling you to get a stubborn lawyer blah blah blah reasons
1. you shouldn't have accepted the refund.
2. Immediately you were refunded you automatically accepted for your legal occupancy to be terminated.
Also have it in mind that they refunded half of your payment and gave you half of the legally specified eviction period thats normally issued to tenants, anyways you can fight to get 6 months but do it in a diplomatic way cos i can guarantee you that there are some crazy home owners who know unlimited tricks of evicting tenants using legal force.

You were giving notice since April 24, did you write back or inform the Landlord or the new owner that you are not accepting the offer?, No you did not. Besides, you also kept the money giving you, so that show concent. Ordinarily, the new owner should be biund by the existing tenancy, meaning that he ought to let you finish your tenancy before doing anything with the flat, whether to rent back to you or demolish or do whatever, he can not just kick you out.

However, in light of your conduct earlier mentioned, i.e refusing to take any steps like writing to convey your disagreement with the offer on one hand, and keeping the money offered you in the other hand, I think you should just pack out since you have been refunded already. No to mention the timing you are now bringing the issue up, just when the notice given you is about to expire. Pks look fo another accomodation fast to avoid stories. Thank you.

I wonder o. You collect half rent already and they still gave you 3 months quit notice. They discussed with you and requested for your account number which you gave them and THEY PAID into your account. All these time, no noise, now it's that to move out as you have agreed when you collected money, you don't want to move out. Is that morally okay? Those people are reasonable enough but you are not.

Dey play... He was refunded meaning he signed off his right to that apartment after which he was given 3 months notice to evacuate, the moment to take this your advice was before he accepted the refund.
If the buyer na better craze man he can be thrown out in a week while his lawyer will be beaten black and blue...

3. What steps can I take if I want to stay until my rent expires in October?

I’ve heard that once rent is paid and acknowledged, even a new landlord must honour the agreement. Is this true?

Please, lawyers and those familiar with Lagos tenancy law, I’d appreciate your input. I don’t want to be bullied or treated unfairly and also 3 months is too short for me

This happened yesterday in my Area. 15 tenants all given quit-notice by the new landlord.

They didn't know the house had been sold since the last 5 months.


They all had to comply and start parking, because the new owner wants to start work next week.

People are just wicked.
