But u sef, you are not proactive at all...... They gave u since April and it is now you are just bringing it to seek for advice.....
U are not a lawyer neither hv u handled issue like this before, being proative is not d issue here sir. D only place she missed d whole ting is by accepting refund, aside that, she has every right to stay in d said apartment until her rent expires.

they refunded half of rent which you've exceeded, they gave you 3months notice, what else do you want, if Landlord have pressing issues, he should surfer because of you! They've done the right thing under law, after 3months go fine somewhere else, or I should tell you what you want to hear? Ok, you can look for a good lawyer and spend your next rent on the case which you will definitely loose

I don’t think the landlord can displace you. The previous owner should have mentioned your active tenancy to him.
Lawyers in this domain will have better answers.
He can be displaced cos he wont be dealing with his old landlord but a new buyer who doesnt have any dealings with him. He had rent of 6 months remaining and he was refunded and given quit notice of 3 months from april which he accepted that was his mistake.

He wont use army he will use godo godo trust me there are tricks to this thing and i can guarantee you that when they come to evict him forcefully none of you advising him on nairaland will stand by him physically highest the court can do is give him extra 2 weeks unless he produces his own original landlord cos the new owner has no business dealings with said tenant also according to the law the new owner can evict him based on trespassing. law

You're supposed to collect the sum of your rent, not have since you're vacating the property before the expiration of your rent. How did you intend to raise enough money to rent another apartment in Lagos within 3 months with the half payment you collected?

I know it is very hard now to get a new apartment. It is very very expensive. However, in this situation where the house has been sold and acquired by a new owner.
I feel there is no need for fight, they should just give you enough time to get another affordable accommodation. It is time you should be fighting for. Besides, you are a yearly tenant, what the law says is that you should be served 6months notice and not 3months.
Lastly, you can also get a Lawyer around you, if they become impatient with you. Get a Lawyer to serve them, the Lawyer won't charge upto 30K for that (15,000-25,000).
Don't be afraid, we all face these things in life.

He should spend more getting a lawyer after he collected money months ago. Lawyer no go tell am true. Them go chop him money and he will still lose. He willingly accepted refund for half of the rent but still want to game them. OP na fraud.

This happened yesterday in my Area. 15 tenants all given quit-notice by the new landlord.

They didn't know the house had been sold since the last 5 months.


They all had to comply and start parking, because the new owner wants to start work next week.

People are just wicked.
This is scenario is different from what OP narrated. In your case the landlord is wicked. In the OP case he is the wicked tenant with mischievous intent.

Your rent expires in October. This is July and you have been given three months notice to quit (August, September, October). They returned part of your rent, the money is with you meaning acceptance.
Please start looking for another house.
They might give you a further three months notice if you do not leave by October.
Please, (especially if you leave with your family there) look for another house biko.

Perfectly said those shouting lawyer up and down dont have one idea of tenancy laws, they dont know that for his case to work in court he must produce his own landlord and not the new buyer. This is my biz and i have seen a lot esp the innovative ways buyers use to evict tenants the dude and his advisers think the buyer also doesnt have genius lawyers 😁😁😁he should thank God buyer gave him 3 months cos i have seen 2 weeks notice..

Those of you encouraging this guy to get a lawyer and sue the landlord, you need to fear God!

I am not encouraging lawlessness and/or intimidation here but you can only toe that path if you have a plan B and are that buoyant and ready for a showdown.

Imagine waking up on a Sunday morning and a bulldozer has pulled down half of the house! Before help would come, it might be Monday and the damage would have been done already, even if you would later get some compensation through the court. And of course, it's not automatic!

Besides, don't be too confident that the law would always be on your side.

Facts is your rent expires October but they came to inform you of the sale in April (six months earlier), gave you half of your rent (which you accepted and kept with you) and gave you a 3 months notice.

Were you expecting a full refund and a longer notice?

Even if you choose to go to court now, the court would ask you of the legal steps you took when all these were happening that you had to wait till almost the end of the quit before acting!

In my own opinion, get the new landlord to give you some more time to look for an alternative accomodation, citing all other associated charges as reasons. With this, you will most likely get the sympathy of the new landlord to extend your tenancy.

In Ebute-Metta in those days when all the old houses were being bought over, the new Landlords recognized all these issues and usually gave the existing tenants some money to help in getting alternative accomodation after the quit notice. With that, not much of those tenants had reasons to stay beyond the expiration of the quit.

So, bro, approach the new landlord (if you have access to him) or your old landlord to reach a compromise! My two cents.

My thoughts exactly money for case he might still lose which means he will incur rent debts based on duration of court case, its better he uses said funds for a better apartment.

The only place where government put their citizens at heart is only Lagos.If this case is in Lagos I will advise you to go to mediation center in your local government explain to them they will get the parties involved on a round table discussion and settle it

Your rent can be 500k and they'll ask you to pay 1m total package. Considering that he has barely stayed there for a year, IT IS CHEATING.

Oga, please vacate the house. That decision was fair and legal. Since we’re in July, it means you can stay until your rent expires in October. They also refunded half of your rent. Please look for another apartment. There’s no need for further advice unless you’re looking for trouble. No court will rule in your favour if you go down that path.

Thank you very much for this. I just wonder why our generation always think that making trouble is the only way out of certain circumstances. In this life, many times, life happens, you encounter unexpected issues of this nature, you just thank God for your life, count your losses and move on.
