Thank you very much for this. I just wonder why our generation always think that making trouble is the only way out of certain circumstances. In this life, many times, life happens, you encounter unexpected issues of this nature, you just thank God for your life, count your losses and move on.

Funny part is with diplomacy he will be given extra months maybe until he even gets a new apartment cos some buyers arent even ready to build yet while some are still calculating many variables of what to do with said property.

Whether you have spent it or not is not the issue, consent to a refund is a red flag.

Don't know rent laws .... but my reasoning is the landlord has given you ample notice ... 3 months ....and offered you compensation in 6 months rent ... and you accepted the package . Now you're trying to separate. Why did you accept the money?... if it were just sent to you...why didn't you return it? ...why hold on to it? Maybe if you did refuse it then the landlord would've made you another offer ...maybe find another apartment at the same price... maybe let the new owner know you will be in the apartment until the expiration of the lease ....and give him the six months rent as compensation. Since you accepted ... the landlord most likely told the new owner you'll be out by July 24 ...the reason the new landlord is not saying anything as yet. Most likely ... if he planned on renting ...at a much higher price.... he already signed lease with tenant to move in on August 1. July 25 ...all hell is likely to break loose ... he will get you out by any means necessary. .What were you doing since April? ..... my advice...move out ..to anywhere ....and now that you're in a desperate situation ...you'll be paying more for less.

I do not think you are entirely correct. As a yearly tenant, he is entitled to a 6 month's quit notice, unless 3 months was was specifically stated in the original agreement. That he collected the refund does not mean anything, he had no choice. He was as is still being threatened. The original tenancy is for 12 months. One party cannot bridge the agreement. He said he is willing to return the refund in order to complete his tenancy.

Now, he should contact a lawyer and have the lawyer write the new landlord stating the validity of his tenancy and stating his willingness to refund the refund. He should also report any threat to the police. He cannot be ejected unlawfully with force.

I noticed that the tenancy expires in 3 months. He should Insist on his legal 6 months quit notice and offer to pay the extra 3 months. That's the position of the tenancy law.

Your rent can be 500k and they'll ask you to pay 1m total package. Considering that he has barely stayed there for a year, IT IS CHEATING.
But if you look at it critically, no landlord will want to cheat a tenant by deciding to sell his own house, so I don’t think it was intentional

The house is your landlord's personal belonging and he has the right to do as he pleases and that includes selling. You were refunded a part of your rent, which you accepted. This action has crippled every legal rights and backing you have towards that house. The best you can do is to plead for time extension.

The purchase/sales of the property must have been completed with the status of the property in sight.

In buying the property, the contract should state the tenancy status of all occupants. The buyer should have that information at the point of sale while the seller has the right to disclose such.

In one word, you stay was part of the sales terms and the new owner does.not have the legal powers to displace you.

I am not a lawyer and do encourage you get one.

What is the definition of ample time? I think, I may be wrong, but I think notice must be minimum of 6 months for a tenant to vacate. I do not think you can pay back 3 months rent in lieu of notice and then give 3 months notice.

The Chenny guy seems to be an unserious and unreasonable human. From what I saw from the OP post, they rented a self-con apartment and defaulted in paying rent from October 2024 to December 2024 kthey rented October 2023) they didn't come here to report their own default.

They received a 3 months notice plus 3 months refund since April, they kept mum. It's now the middle of July and the funny dude is coming here.

OP should save whatever money because the landlord don over try self! I suspect the OP is insisting on a non-existent right to overstay, and that's the reason the landlord is threatening to use soldiers. OP no try at all undecided

You collect money, you want still stay till the end of your expiration of your initial rent, your plan na to still stay another six months when your rent expire, you lie. Waytin person nor fit do you, you want to dey do someone else. You wan claim right when you nor kwn your left.
Go dey find house now, you know as Lagos house wahala dey be.

You accepted a partial refund of your rent and a three-month quit notice. What are you saying again now? Just know that tenancy laws are not made to favor tenants alone. If you choose to stay in that house without having any agreement with the new owner, trust me, you could be seriously embarrassed — you can be forcefully evicted.

Those people telling you to stay put don’t know what they’re talking about. Remember, you’re the one in this mess — they’re not. Go and talk to the new owner. Plead for a little more time while you make a serious effort to find new accommodation.

Please note that whatever I say here is based on my training as a Lawyer.

A landlord has a legal right to sell his property.

The new owner of the property automatically becomes your Landlord.

As your landlord he has the right to issue you quit notice but the said notice cannot expire before the expiration of your current rent.

The length of notice you’re entitled to is determined by the tenancy agreement signed between you and your initial landlord, but in the absence of that, it will be determined by the provisions of the Lagos State tenancy Law which outlines duration of quit notice based on length of rent paid eg whether Monthly, quarterly, Half yearly or Yearly.

Refund of rent or part of ,must be based on mutual agreement.

Acceptance of refund of part rent or unused rent implies agreement on your part to vacate the premises.

Issue of when to vacate is basically another thing.

Conclusion:
Consult your Lawyer so he can write to your Landlord.

You had better get a house and move out.

1. The agreement you signed was with your previous Landlord.
The new landlord has right to do what he he wants with his house.
The documents of that house changed the moment the property was sold. The cover later pf your agreement carried the name of your previous Landlord.

2 You landlord refunding you the money has completely made whatever contract and agreement null and void.
He no longer owns the house and he has also refunded you what he owes you.

3 Those telling you the new Landlord can ask you to leave, let me ask youa question, did you have any documented agreement with your previous that he will transfer your tenancy to your a new owner in a situation like this?

The law is not about emotions the law deals with facts and the fact is that you have no valid contract with the new house owner and the house owner you had an agreement with has paid you and even given more time to leave.

You will be kicked out of the house and nothing will happen

As a property consultant. I put it to you that you can be evicted with reason or no reason 6 months to the expiration of your rent (if you're a yearly tenant).
In your case 50% was refunded and an ample 90 days notice was issued.,
1. You collected half your rent which says yes I consent to this agreement
2. You didn't protest when the 90 days notice was issued which translates you agreed to move out
3. New landlord has zero business with you, your argument should be with erstwhile landlord .

Verdict: Pack out now!

My situation is a little different from yours. I renewed my rent on the 25th of February, so my rent is supposed to expire on the 25th of February 2026. Landlord served me a 3 months quit notice on the 8th of July,that I should leave the apartment on it before the 28th of September, because he wants to use the apartment and the he would refund the remaining amount left on the rent.

I’m seeking legal advice on the right step to take. Any property lawyer in the house should kindly give his/her take on this issue.

Don't mind the guy. He is only crying because the notice given is due. Accepting a refund meant he agreed to the quit notice issued. You don chop the money, na nau you wan cry enter street. You will lose this case anywhere you go.

If you had no intention of leaving, you should have turned down the refund and insisted on living through the entire period of your tenancy. Don't allow lawyers waste your time and money. Just pack out!

Did you read his story at all? I doubt you understood what he said. Many of you don't understand how agreement works. Accepting that refund meant he consented to the urgent quit notice! This case is now centered around the refund he accepted. The new landlord is a smart person. He won the case from the start. That refund did the magic.

You don collect money, you say you nor go pack? He will be humiliated out of that house, believe me. Three months quit notice is the legal requirement for six months tenancy. Dude has lived the six months plus three months grace period which is recognised by law. What else does he want?
