You should not have collected the refund. Now that you did the law states you agreed to collect the refund and accept the quit notice.

Hello Nairalanders,

I need your advice urgently.

I rented a self-contained apartment in Lagos, and my rent is valid until the end of October this year. Just recently, I was informed that the landlord has sold the house.

Now here’s what happened:
• They refunded half of my rent (without my prior agreement),
• And issued me a 3-month notice to vacate.

I never agreed to terminate my tenancy early or to receive a refund — they just gave me the money and served the notice. I feel like I’m being indirectly forced out before the agreed expiration date of my rent.

Please, I want to know:
1. Is this legal under Lagos tenancy law?
2. Can they harass or pressure me out of the house since it’s now sold?
3. What steps can I take if I want to stay until my rent expires in October?

I’ve heard that once rent is paid and acknowledged, even a new landlord must honour the agreement. Is this true?

Please, lawyers and those familiar with Lagos tenancy law, I’d appreciate your input. I don’t want to be bullied or treated unfairly and also 3 months is too short for me

Thanks in advance!
With what you wrote here, park out of that house ASAP.

You have already put yourself as "tenant at will" the moment you agreed and accepted the refund. You have terminated your right as tenant.. you are at the new owner's mercy now, all you will need to do is to seat with and plead for more time to get a new space.

The refund you collected was a game changer for the new owner. There is nothing your lawyer can do rather than to plead on your behalf for more time to get a new space.

One, the guy has eaten the money, two, he can't afford the services of a lawyer, that's why he came to a public forum. Best advice for him is to park out.

If you accepted the refund then you don't have a case, Sorry.

Acceptance of the refund is an evidence that your tenancy agreement is over.

You had the right to reject the refund and insist that you must live out your tenancy agreement to the end. And the court will be on your side.

But you did not do that.
The law isn't on your side.

Add the money you would spend on a lawyer and court case to what you already have, and use it to get a new apartment. Don’t go looking for trouble where there is none.

They refunded half his rent already and gave him additional 3 months to look for apternative. This is very compliant with the law.

Make una stop to the encourage bad thing.

But now that you’ve been refunded and you willingly accepted the refund, your tenancy agreement has ended as long as they gave you ample time to search for another accommodation after your refund (they can’t refund you today and ask you to pack out tomorrow)

So they refunded you and gave you 3 months to move out and you are now complaining. You can’t eat your cake and still keep it

You shouldn’t have agreed to the refund, you should have waited till your rent expires before you agree to move out because that is the official time your tenancy agreement ceases, but by willingly collecting a refund, you shot yourself in the foot
Gow can people be tgis selfish
You collected a whole half of your rent back and 3 months notice and you are still here complaining

You shouldn't have accept that Refund until your Rent Expired. The acceptance cancel your initial Tenancy that's why the New guy gave you only 3 months to vacate the Property.

Just tell him to give you time to get another apartment, maybe he will see reason with you.

A lot of people are telling you to get a good Lawyer. That won't solve your issue.

The house is about to be tear down and those Lagos Developers/Landlords are another breed of Humans.

I bet the House is at Ebute Meta?

When did they give you back the money?

You should have not collected it, however they’re on the right track.

They should have served you 6 months before the exploration of your rent, but according to you now, you still have 3 months left, so they’ll still give you another 3 months if you can’t find house follow by 7 days. Then, they can send your property out. Note that you’ll pay your extra 3 months o, else they decided to give you

First of all what on earth will make you accept the refund. Is the refund with you or not. If it's with you then you can't have your refund and still be fighting to remain in the house. You accepted refund allow 3 months notice to run down and now you saw you cant meet up you are tunning to nairaland. Why noylt raise alarm 3months ago while rejecting the refund. But if you didn't collect the refund go to court.

I am not a lawyer..
Breach of contract:
If the tenant violates the tenancy agreement (e.g., non-payment of rent, property damage), the landlord may have grounds for immediate eviction, even if the rent has not expired.
Legal recourse:
If a landlord unlawfully evicts a tenant before the notice period expires, the tenant can seek legal remedies.
Go and get yourself a good lawyer...you have won the case already bro!!!
Won case when he has collected part of his rent? He will waste the little he has to rent another apartment on the case and still loss

3 months is not too short. Just admit that you procrastinated forgetting that 3 months come very quickly.

Don't know rent laws .... but my reasoning is the landlord has given you ample notice ... 3 months ....and offered you compensation in 6 months rent ... and you accepted the package . Now you're trying to separate. Why did you accept the money?... if it were just sent to you...why didn't you return it? ...why hold on to it? Maybe if you did refuse it then the landlord would've made you another offer ...maybe find another apartment at the same price... maybe let the new owner know you will be in the apartment until the expiration of the lease ....and give him the six months rent as compensation. Since you accepted ... the landlord most likely told the new owner you'll be out by July 24 ...the reason the new landlord is not saying anything as yet. Most likely ... if he planned on renting ...at a much higher price.... he already signed lease with tenant to move in on August 1. July 25 ...all hell is likely to break loose ... he will get you out by any means necessary. .What were you doing since April? ..... my advice...move out ..to anywhere ....and now that you're in a desperate situation ...you'll be paying more for less.

Hmmm .... person want to swallow eba and belch at the same time

The last paragraph got me rolling in laughter.

The law will definitely recognizes 3 month quit notice as enough time although am not saying it's the final

Your rent is not due for renewal and they already refunded half of your yearly rent which is a fair deal

The only issue is the total package thing and this has why we need this agency work to be highly regulated

I will advise you look for another house because it's not worth the stress to drag it further with the new owner although you can negotiate with him and see if he will retain you as his tenant
I concur with this.

This man had since April to clear this up, it's now in July he's bringing it up.

Allow all these broke online people without sense to give you false moral by the time you jammed serious wahala your your eyes go clear.

You don't even have the money to look for another apartment and you are looking for court case forgetting that this is Nigeria.

Wealthy people are even Avoiding wahala in this country.

You shouldn’t have collected the refund since you know you were not ready to move out before your rent expires. The refund should have gone to your new landlord and he’s to determine whether or not to retain you as tenant when your current rent expires. But by accepting the refund since April means that you consented to vacating the property after 3 months. Unfortunately you can not eat your cake and still have it, Just look for another accommodation before you put yourself in unnecessary trouble.

The notice was given to me April 24 and to expire this month July 24. I haven’t been able to raise complete money for a new apartment given the whole agency and agreement nonsense. Plus I just moved into the house November 2023 and renewed my rent last year December. All of this is really shocking and unplanned. Please lawyers assist on the way out.
By law, the new landlord did the right thing. As long as you were refunded and you willfully accepted it and also a reasonable amount of time duration was given to you as stipulated by Law (3 months) then I see nothing wrong with this.

However, the new landlord shouldn't use army to force you out. You can simply beg him to give you more time or a minimum of a month so as to enable you get another place

Mine, I paid rent in October 1st (expiration rent date) to the designated account landlord, when he came back from Canada in December, he gave me a letter, telling me he's increasing the rent. When I opened the letter, I saw that it will take effect from March this year.
I don't know what to do because, I am not intending to pay any money aside the increased new rent in this coming October.

I think you're right. But all he's left to do is to plead for a month extra to vacate since has not been able to find a house. He doesn't even have money to fund any case that would result to that. So, he's at the mercy of the new landlord.

I have a case like this but not like his case.

Good morning

You paid Oct 2024.
In Dec 2024 he gave you a letter saying that his rent will increase.
That means the letter is giving u an "ahead notice " of which your next rent will take effect. In Oct 2025.
If you paid your rent complete as at that time, the effect is Oct 2025 as you are on yearly rent.
If you haven't paid completely you will incur the increase on the balance for the outstanding month starting from March
