It happened that I parked my car on the sideway on a road. My store faces the road. Vehicles do park there close to their stores.
This truck driver while on a high speed, he didn't have wiper according to him. His wiper wasn't working, he had a collegue/conductor and they were carrying farm products. His second while the driver was on a high speed, cleaned the front glass without notifying the driver, this led to poor visibility and with such high speed, he lost control and ran straight to my car from the rear. It was a heavy smash. I already opened my car boot to place my generator inside to take it home since we already closed and my solar at home was already down. It could have killed me actually if not for a car that I got that delayed me taking the generator to my car boot. My car has a sport design and a luxury brand so, the book is not big, usually takes me time to place the generator inside carefully. This could have led to my death because the car would have ran into me.

I called the police when the accident happened. The owner of the truck came, pleaded and begged that I should take things easy that he would cover the cost of fixing my car. From the way he begged, I thought he was a reasonable human. I had mercy and agreed that I will just take things easy and he will cover the cost of my car. My car is barely 7 months old and was toks when I bought it.
Police came and tolled the truck to their station while I drove my car to the station.
We were asked to come the next day. I went there. Since he begged and was ready to cover the cost of fixing my car, I went there with the intent of peace.
I brought in pannel beater and my mechanic and the estimated cost was put at 580k after I decided to manage the boot, the silencer and the rear full light that had a crack. I said only the back glass which got broken into pieces and the rear bumber should be changed, then the car can be painted on the rear and pay the workmanship.
After they begged further, I decided that they should cover just 550k. I didnt add the tyre that got damaged. I was like I would cover those cost since he is begging and showed interest in covering the cost.
He wrote and signed an undertaking with the police that he would pay deposit the next day and pay the balance the coming saturday. He exchanged number with me and said I should call him by 2pm the next day, he would pay 300k naira as deposit.

Since I had the cash, I sent the amount to the mechanic to start sourcing for the part and fixing. I didn't want to delay my car. I have only one.
Fast forward the next day, he asked for my account details which I sent. This man since then has refused to pick call and has not reported at the police station.
This is so painful because I thought he is reasonable. I regreted following this path because I know how to handle such a person normally and he would have dropped the cash.
As at stands now, how do I recover my money? The police are with his truck as they said. His truck has no full light working, wiper doesn't work, traffigator light doesn't work. I don't know if he still values the truck.
What are my options, guys?

I don't see police trying that. The man handling the case has recieved a call from a commissioner of police over the matter. The problem is with the man it self.
The option maybe taking him to court. I have never been to court. Will I win?

This type of people, what suites them best is taking soldiers to pick him up and he will raise money and fix my car. But I already involved police. I have no other option than court right now because he is not picking calls, not responding to messages. I was thinking the man is responsible.
I spent over 600k to fix the car. For this economy, with his attitude, I can't let go. He would have killed me or one other lady who stood behind my car waiting for taxi before she left. It wasn't up to 1 minutes that she left, before his illitrate driver smashed my car.

we can’t waste advice on something that might not be true.

You could have insisted on the original documents of the truck and hand it over after completion of repairs.

He would pay u in 4weeks ,he signed an undertaking and didn't show up or respond u,what now makes u feel he would pay after disappointing you.alaye the truck driver,can never ever pay for the damages. Even if him get the money,he can never pay,rather he will use it to guide. U should have dealth with him on the spot,pieces the truck tyres,windscreen,pedals,steering,.if u had done that,u will have been satisfied.
After 4 weeks,he go switch off phone,bribe police with 5k or 10k,them go release him truck and end of case

It seems the truck is not insured. Go to the police station, get the officer in charge of the case to call the man, since the date for undertaking has passed, let them find a buyer for the truck, sell it off and collect your full money spent. Do not have mercy on the man because his actions shows he will do worse to you.

Though he messaged me yesterday and paid in 140k
He pleaded that he didnt see the cash yet and pleaded for extended time and to pay in installment. I accepted his plea. He will pay weekly for next three weeks to complete the payment before we can close the case at the police station.

Well, make sure you and the IPO lock hands, collect every kobo spent, get receipts if possible, do not allow the truck leave the station, and no let the goods out of the truck too. That's the only way to force his hand, because the truck can be abandoned.

Na why e good to get military connect. Last December, a truck failed brake in traffic and smashed into me. Called my lil bro who is an air Force officer. He drove down there with 3 other officers. We went straight to my mechanic. The put a cost for a new boot, panel beating and painting. The truck manager Paid there and then.

This type of case, there should be a clause that failure to pay at end of given grace period the offenders vehicle will be sold and money will be used to fix the damages.

Seems you don't know what the law says in regards to debt. Why do you think people use police to get back money and not court? Let me give you an idea. The judge will ask for monthly income, ask for his financial engagements and after much back and forth, the judge will do what is in the best interest of the debt repayer unless it's a case of advance fee fraud etc.
