The SC in the rivers case said no court can declare a seat vacant. It said that responsibility only belongs to the Speaker of the House
I belive that is the latest ruling of the court and it effectively nullifies the earlier ruling

Listen a 5man panel of the Supreme Court cannot overturn decisions of a full Court.

The judgement preceding that was a Constitutional one and a full panel of 7 sat on it, it remains unimpeachable unlike the Rivers matter wherein 5 Judges sat. This is the confusion this SC has caused.

If elected politicians wish to switch parties, they ought to be required to resign from the position they hold in the government (if any) before they can change parties.

This is a kangaroo judgement it will be overturned at the appeal court
