The 2013 amendment under which he was charged is an amendment to the 2011 Act. The actual law is the 2011 law, the 2013 version was an amendment to the 2011 act or in other words a different version of the 2011 law.

The 2022 law repealed the 2011act and by extension the 2013 amendment or version under which he was charged.

However in section 98 (3) of the new 2022 act, it clearly states as follows:


(3) Any proceeding, prosecution, sentence, judgment, charge or cause of action pending or existing immediately before the commencement of this Act under any of the repealed Act in respect of any right, interest, obligation or liability, may be continued or commenced, as the case may be, and any determination of a court of law, tribunal or other authorities or person may be enforced to the same extent that such proceeding, prosecution, sentence, judgment, charge, cause of action or determination might have been continued, commenced or enforced as if this Act had not been made.

The "amended" seven-count charge filed by the Federal Government against Nnamdi Kanu on 11 November 2022 is incurably defective in law.
By that date, the Terrorism (Prevention) (Amendment) Act, 2013, under which the charge was framed had already been repealed by Section 98 of the Terrorism (Prevention and Prohibition) Act, 2022, assented to on 13 May 2022 and gazetted on 16 May 2022.

Once a statute is repealed, it ceases to have any legal force and no fresh proceedings may validly be initiated under it.

The November 2022 charge cannot be regarded as a mere amendment. The previous charge had 15 counts, while the new filing has only 7.....this is clearly showing that it replaces the original charge .In substance and in form, it introduces new offences, making it a fresh charge rather than a continuation of any pending case.

The saving or transitional provisions of the 2022 Act apply only to pending proceedings, not to new ones commenced after repeal like the federal government has done.

Accordingly, prosecuting Nnamdi Kanu under a repealed statute offends Section 36(12) of the 1999 Constitution (as amended), which forbids conviction or trial for an offence not defined or punishable under a law in force at the material time. The entire proceeding is therefore a nullity, having been predicated on a law that no longer exists. In law, a charge cannot stand upon nothing; it must collapse.
