Wike is a Barrister,at Law,
He is the Commander of Abuja Land- as a Governor and has a Final say on the Land in Abuja, under his Jurisdiction,like any Other Landed Properties,in any State in Nigeria!
While one is not supporting Wike temperament,but as a Governor of the FTC Abuja,he has a right to visit the Place and may be the FTC Officials were Chased away before,he Wike - has All the Authority to go and have a first knowledge of - What Is Going On there!

Imagine a retired Naval child given orders against a minister of the Federal Republic.

It's obvious that you have not had case in court before or got involved in land matters litigation.

That is bad PR to the retired officer. He could actually land in bigger problems ,even arrested and prosecuted.

The Minister represents the President. If he takes on the Minister then he is taking on the President and that's bad for him.

Interestingly, the retired officer wouldn't send his own son on such errand and when he was a young officer, he wasn't having a shouting match publicly with constituted authorities or behaving the way the young officer behaved to the Minister. If he was behaving like that he would not get to the pinnacle of his career.

FG will investigate the appropriateness or otherwise of a serving or retired senior military officer to give order to a junior officer to restrain a Minister on his lawful duty from performing his duty.
That will be visited to ensure that such disgraceful scene never happens again.

That Junior Officer should have known the limits of his discretion and just kept quiet after saying he was obeying order which has now turned out to be an order given by a retired military officer.

So if tomorrow, retired or serving officers tell him to slap a government official, he will do it niyen.

It was the President he was challenging by placing the 'order ' above the authority of the president delegated to the Minister.

Whatever incentive he got or was promised by the retired Senior Officer for him to behave in that manner must be investigated too. Haba!

It is completely unacceptable that the Minister was prevented from performing his lawful duty by a junior officer acting on the order of a retired military officer. Everyone including the junior officer and the retired Senior naval officer should by now have been rounded up and quizzed if it's not already done.

That video is a very sad event that embarrasses the President and the nation.

Which court?

Wike is causing problems that may take decades and numerous lawsuits to fix in Abuja. He cannot arbitrarily revoke lands and reallocate to his cronies. He tried that rubbish with Mrs Rita Lori who straightened him out. Unluckily for him, these hectares in question were allocated to former and current high-ranking military officials. He better be ready for war. As inter alia noted, this is one distraction Tinubu doesn't need right now.

OFFICER YERIMA BREACHED THE LAW IN THAT FACEOFF WITH NYESOM WIKE

Brushing sentiments aside, I hereby condemn in totality the actions of the Naval Officer, A.M. Yerima, who obstructed the FCT Minister from gaining access into that parcel of land, under the guise of ‘obeying superior orders.’ The duty of a junior officer to obey the orders of his superiors, even though strongly upheld in military and paramilitary circles, has its own limitations recognised by no other authority but the Supreme Court of Nigeria. I shall establish this anon.

In the recent case of Onunze vs. State (2023) 8 NWLR (Pt. 1885) 61 at 108 SC, the Supreme Court held emphatically, per Ogunwunmiju, JSC, thus:

“My Lords, the obligation to obey the orders of a superior does not include orders that are palpably illegal or manifestly unjust. Every military or police officer swears an oath upon commissioning. The Oath is not to obey all orders, it is to “preserve”, “protect” and defend the Constitution of the Federal Republic of Nigeria against all enemies, foreign and domestic. When an officer obeys palpably illegal orders, they become personally liable for their actions and would be expected to face court martial or official sanction for the wrongdoing.”

In the earlier decision of Nigeria Air Force vs. James (2002) 18 NWLR (Pt. 798) 295 at 324 SC, Onu, JSC, delivering the lead judgment of the Supreme Court, held firmly, subjugating military personnel to civilian authority and disparaging obedience to illegal orders, as follows:

“See the case of Pius Nwaogu v. The State (1972) 1 All NLR 149 where it was held, inter alia, that "a soldier is responsible to Military and Civil Law and it is monstrous to suppose that a soldier could be protected when the order is grossly and manifestly illegal. Of course, there is the other proposition that a soldier is only bound to obey lawful orders and is responsible if he obeys an order not strictly lawful.’"

The illegality in that order stems primarily from the fact that no service law of the military permits a serving military officer to mount guard at the private construction site of his boss, especially under suspicious circumstances like this. The retired Naval Officer ought, under the circumstances, to have engaged the civil police, if he suspected likelihood of arson or criminal trespass.

Additionally, Barr. Nyesom Wike is the equivalent of Governor of a State – he being the Minister of the Federal Capital Territory, Abuja. More importantly, all lands in the FCT Abuja, by section 297(2) of the 1999 Constitution of Nigeria, 1999 as amended, belong to the Federal Republic of Nigeria. By section 302 of the same Constitution, read together with other extant Acts of the National Assembly, the President of Nigeria has delegated all powers with respect to land administration in the FCT Abuja to the Hon. Minister. Going by constitutional and administrative law, therefore, Mr. Wike stood in loco the President of Nigeria and Commander-in-Chief of the Nigerian Armed Forces on that fateful day. Consequently, even if the superior officer were still in service, he would not disobey Mr. Wike or obstruct him from entering the land. This was an affront to the civil authority of Mr. President.

The Minister’s method may be brash; but it is legal and lawful in all respects. Rather, it is the officer who obstructed him that has breached not just the Nigerian Constitution, but also service and extant regulatory laws. For the avoidance of any doubt, section 114 of the Armed Forces Act makes military personnel criminally liable for civil offences. This means the officer in question could be arraigned before a Court Martial for obstructing a public officer from performing his public duties, et cetera.

In conclusion, celebrating the humiliation of Nyesom Wike, simply because he is a ‘big man’ or simply because he is not liked by certain persons begs the real issue here. If such intolerable conduct by the young officer is not punished or is celebrated, this may unleash a reign of terror by the men in khaki against hapless civilians – with a grin or boast that ‘we did it to Wike and nothing happened.’ This is not Nigeria of our dream!

that had been an issue with Nigeria system right from a very long term.. if peoke like Obasanjo . Abdusalam and babamgida still have troops of military personnel guiding their homes and property. Believe me those entities have a lot they’re hiding and protecting.. they’re t be reason for Nigeria backwardness .. the retired military personnel.. they’ve the capacity too help but they rather take all the country for them self and whatever resources there in it.. so they need all the protection and military powered to perpetrate their never ending stealing and corruption

The only person that can give a counter order to the orders of Vice Admiral Gambo is the Commander-In-Chief, Tinubu, but even Tinubu must be careful because there’s a way he’d handle the matter in favour of the law (Wike) and he would anger the rank and file of the military establishment which will not be good at all.

Remember he just survived a coup.

There’s a reason people like AZ Gambo are left alone to do their thing as far as their actions are not very much against the law or threat to public peace and order.

How much does Wike and FCT ministry want to generate from the General registering for his development levy. It’s a totally unnecessary fracas.

I won’t be surprised if Wike is sacked because of this.
Go and sack him naaaa. U dont know that he has been a bone on Tinubu throat. Rivers state has high voters turn out in all elections and Tinubu would not want to lose that state to opposition party come 2027.
