The Magistrate Court of Abia State sitting in Olori, Ikwuano Magisterial District, has stopped the planned burial of the late traditional ruler of Ntalakwu Oboro Autonomous Community, HRH Prof. Sam Ajiri, pending the conduct of an autopsy to determine the cause and time of his death.

Chief Magistrate N. R. Olujie gave the order after hearing a motion filed by the deceased monarch’s first son, Mr. Dike Ajiri, and four others—Chief Uzondu Johnson, Mr. Armstrong Okorocha, Mr. Henry Ekpe, and Mr. Onuoha Chukwuno—against Mrs. Chinwe Ajiri, widow of the late monarch.

Also joined as respondents in the suit are Ashes to Ashes Funerals Limited; the AIG Zone 9, Nigeria Police Command; and the Inspector-General of Police.

The plaintiffs, through their counsel, Orgmore Kanu, had asked the court to restrain the defendants from proceeding with the burial of the monarch without an autopsy, citing the need to ascertain the true cause of death.

They also accused Mrs. Ajiri of attempting to carry out the burial without the consent of the deceased’s first wife, Mrs. Eileen Ajiri, his first son, and his brothers.

In his ruling, Magistrate Olujie held that the application had merit and that granting it would serve the ends of justice.

The court relied on a legal opinion issued by AIG Emmanuel Ade, Director of Legal Services at the Force Headquarters, Abuja, which recommended that an autopsy be conducted by a government-approved medical team with representatives from both parties present.

Consequently, the court restrained Mrs. Ajiri from burying the late monarch until the autopsy is completed as requested by his first son, first wife, and brothers.

The court also restrained Ashes to Ashes Funerals Limited from releasing the monarch’s remains to Mrs. Ajiri or any other person without the consent of his son, who was recognized by the court as the head of the family, along with the monarch’s kinsmen and cabinet.

Similarly, the court barred Mrs. Ajiri from using hired thugs or armed men to carry out or influence the burial of the late traditional ruler.

The court further directed the AIG Zone 9, the Inspector-General of Police, and all police officers involved in the case to retain custody of the mortuary tally and not release it to any individual except for the purpose of conducting the autopsy.

The order followed growing tension in the Ntalakwu Oboro community over the burial arrangements of the late monarch, whose death in September 2024 has sparked controversy among family members, as Mrs. Ajiri had allegedly told the police in Zone 9, in her written statement, that the late Eze Ajiri died in December 2024.

This autopsy became necessary due to the expressed concern of the first son, Prince Dike Ajiri, regarding the contradictory dates surrounding his father’s death. According to the mortuary tally, the late Mr. Ajiri was deposited by Mrs. Chinwe Ajiri in September 2024, whereas in her statement before Zone 9 Police Headquarters, Umuahia, she indicated that the death occurred in December 2024. This inconsistency raised serious questions as to what truly transpired. Consequently, the family deemed it imperative to conduct an autopsy, not only to ascertain the actual circumstances and time of death, but also to identify any underlying medical condition that could be hereditary, thereby providing vital information beneficial to the health and wellbeing of other family members.

Reading through the article one can see that there was most likely a very big distance between the king his first wife and her entire children, looks like they weren't living with him or even close to him, because they didn't know the exact date he died, neither did they even know the exact date he was kept in the mortuary, like the second wife was the one running the whole thing and giving them whatever information she wanted to.

Now imagine what will be the most attractive quality a Professor will love most in a woman who will be his official wife/Queen?

This is the setback of polygamy & having children from different women. The man should be allowed to rest in peace. What do they intend to achieve now in an autopsy request? It should've been done immediately after his demise when the body was released fresh. I'm sure he would've been embalmed for preservation for burial.

Why rushing to buried him?

I support the autopsy must be done only those who want to hide criminality claimed you must bury somebody before 12 noon and so on.

How can a man not sick or in any health challenge just die like that and rushed to buried him? If he actually died on natural cause then "why rushed to buried him"?

I’ve been in court where this was an issue, falana and another Senior Advocate were representing both parties and the court prepared the burial rites for both parties, who will do what for the burial and location etc because the burial precedes the substantive suit of who has a claim to the property of the deceased.

In this case it was a medical doctor, this was 9 months after his death, the family were still bickering about who has a claim to his body.

The second wife said he died in December 24 ...then she said he died in September. Did she make a mistake and said December and they held on to that? If he died in December then it shows the first wife and son do not communicate with him nor make enquiries ... he was not on their radar. Regardless ... especially in this case an autopsy should be automatic to avoid suspicions and accusations. If he died in December ... and not buried to date ...almost a year ... it has to be he was embalmed. When a body is embalmed it is extremely difficult to accurately carry out an autopsy. If the body was not embalmed then it is more likely he died in September and the autopsy can determine cause of death. According to the report it seems according to law the first son and not the first wife has the power. More problems in death than in life .

This is actually stupidity on the second wife's part,apart from the fishy nature of the whole thing.
It's not just commonsense but culturally and legally safe to inform the family about his death.
You can then legally bar the first wife and her children during the burial if the deceased so wish and you can show evidence of that(possible that the man have been totally estranged from the first wife and the chidren from the first marriage,him thus barring them from partaking in his burial;{stranger things have happened})but wanting to do everything,even excluding the kingsmen and elders,of a paramount ruler for that matter,raises a whole lot of questions about the second wife's true intentions. The autopsy will likely be done if it was the consent of the immediate family, legal wife to be precise.
But if there's clash between her and the family, it go long. She ll likely win if she get her facts right.
That's why am an advocate of court marriage. It gives us a leverage when situation like this occur.
