Supreme Court:

If any entity has grievances on the non release of the local government, it should be local government councils and not the state. The local government has right to sue and be sued as provided by the constitution.

On the ground, the plaintif case is hereby dismissed and it is struck out.

Ratio 4: The Plaintiff, AG of Osun lacks locus standi to institute the action to invoke the original jurisdiction of the Supreme Court as there is no dispute between the Federal Government and the Osun State Governmt. The case is incompetent and hereby stuck out.

Ratio 5: Osun LGAs are autonomous entities that ought to have filed the case themselves in an appropriate High Court. AG of Osun is a meddlesome interloper and lacks locus standi to invoke SC original jurisdiction. LGAs are autonomous and Osun State Government and its AG cannot file this action.

Ratio 6: The Federal Government is directed to remit all LG funds throughout the Federation to all LGAs nationwide—failure to do so amounts to disobedience of the rule of law. The case is hereby struck out. 6 of 7, the full Panel agreed, and only one dissented.

In the final analysis,suit SC/ CV/ 277 /2025 BTW AG OSUN V AGF is hereby struck out by the Supreme Court.Osun AG,Osun State Governmt and Governor Ademola Adeleke lost out in the Supreme Court over LG tussle.

Supreme Court Strikes Osun’s suit on withheld Local Govt funds over jurisdiction

In a split decision of six Justice to one, the Supreme Court on Friday struck out a suit filed by the Attorney General of Osun State against the Attorney General of the Federation (AGF), in relation to the dispute over the withheld allocations due to local governments in the state.

The Apex Court held that the Osun state Attorney General and Commissioner for Justice has no legal right to have instituted the case on behalf of the 30 local governments in the state.

That Court held that those who won the local government election and having been inaugurated are the jurisdict persons that can sue and be sued directly.

In a judgment on Friday, the Supreme Court held that the federal government was wrong in withholding the local government fund adding that the action was in grave breach of the 1999 Constitution.

Justice Mohammed Baba Idris who read the lead judgment said that the hand of the federal government was soiled in its decision to unjustly seize fund and admonished it to strictly ensure that the funds are directly channeled to local accounts.

The Court dismisses AGF's contempt allegations against Osun adding that he was in more contempt than Osun by not paying the fund as required by law.

Justice Idris however said that since there was no evidence that Osun Attorney General was briefed by the local governments, he ought not to have filed the case on their behalf.

In a minority judgment by Justice Emmanuel Akomaye Agim, he disagreed with the six other justices, holding that Osun Attorney General has the right to institute the case.

Justice Agim said that the action of the federal government in withholding the local governments funds was in bad taste because it was capable of crippling the activities of the Councils.

You have a point. But note that this judgement is bound to benefit all local governments in Nigeria. Being a Supreme Court judgement makes it a law on it's own and a standard that must be applied across board.

The Supreme Court of Nigeria has struck out a suit filed by the Attorney General of Osun State, Oluwole Jimi-Bada, against the Attorney General of the Federation (AGF), Lateef Fagbemi, in relation to the dispute over the withheld allocations due to local governments in the state.

The LGs in 36 States have autonomy but some are loyal to their governors. But now that Osun State case has open more legal understanding, I will see some LG chairmen standing Thier feet.

The court must deliver judgement that would make any opposition to Tinubu handicapped, be it state government or party affairs, the one they can't outright deliver, they wont hear the case until, it becomes academic (supreme court on Rivers State of emergency), and the one they hear, they will deliver it, in such away, it would bring confusion (PDP & LP party affairs)

Court had never been crippled like this in the history of Nigeria, not even during inglorious days of Abacha.

Is it a new judgment? The supreme Court already ruled on local government autonomy more than two years ago. Instead of Tinubu to implement the judgment, he used it to negotiate with the governors to decamp to the APC. Why is the judgement only being selectively implemented in Osun state? This isn't governance.

This judgement has not awarded victory to any party since the main issue was not determined

The judgement did not give the legal control of local govt to APC nor PDP

This SC is the most inconsistent and unserious in our history
Who brought the LG funds autonomy matter to the SC? Was it the LGs or the FG? Were they sleeping then when they gave judgement in favour of FG in a matter it clearly had no locus?
They should keep embarrassing themselves
