Tonye Cole vs Wike: FCT High Court schedules case mention for December 9

The High Court of the Federal Capital Territory (FCT) will, on 9 December 2025, hear the mention of suit number CV/4502/25 filed by Tonye Patrick Cole against Nyesom Ezenwo Wike, minister of the Federal Capital Territory, and Channels Incorporated Limited.

Mr Cole, the 2023 APC governorship candidate in Rivers State, is seeking N40 billion in damages over alleged defamatory statements made by Mr Wike during a live broadcast on Channels TV’s “Politics Today” on 18 September.

According to the writ of summons and the attached statement of claim, Mr Cole said Mr Wike’s statements during a live broadcast on Channels TV’s “Politics Today” on 18 September were false, malicious, offensive, and damaging to his reputation in personal, professional, and public capacities.

Court documents indicate that Mr Wike referred to Mr Cole in a manner suggesting financial impropriety and mismanagement of state resources, including allegations related to Rivers State gas and the Olympia Hotel.

Mr Cole’s legal team, led by J.S. Okutepa, argued that the statements are defamatory, as they impute dishonesty and wrongdoing, gravely injuring his client’s standing both nationally and internationally.

The claimant is seeking N40 billion for alleged damages resulting from what he described as a “malicious, reckless, and unfounded defamatory broadcast and publications,” which caused him injury, humiliation, mental anguish, and reputational harm.

Mr Cole is also seeking N500 million for the cost of the legal action, as well as several injunctive and declaratory reliefs. These include a declaration that the statements were false and defamatory, an order directing the defendants to retract the claims and remove all copies from all platforms, and a public apology broadcast on Channels TV and published in at least five national newspapers.

The claimant also seeks a perpetual injunction restraining the defendants from further publishing or disseminating defamatory material related to him.

Mr Cole’s legal team said a pre-action notice and letter of demand dated 8 October were served on both Mr Wike and Channels Television, but the defendants failed to comply, prompting the initiation of court proceedings.

The court has directed the defendants to enter an appearance within 21 days of service of the writ.

what makes you assume Wike is lying? he is a lawyer, he was the governor, he has inside knowledge.

that I sue you for defamation (especially in Nigeria) does not mean I am right. The act of suing for defamation itself is a play. Show me a case where the case has gone to the end.

i am not saying Wike is right or wrong or Cole is right or wrong but in Nigeria suing for defamation means nothing. The case will drag for years. The litigant will say his accuser was lying and to prove I have sued him, usually the matter will die down, the matter will die and thats the last you will hear of the matter. Didnt Afe Babalola Sue Farotinmi for defamation, what happened? Today both sides will claim victory, one will say I was begged to withdraw the suit, the other will say God saved him he withdrew the suit. So the fact that you make an allegation and I sue you doesnt mean you are not right.

The day this case goes to judgement is the day you can say Wike was talking anyhow, if it was proved so in court. just like Obi's case against Adeyanju, the day you hear a judge delivered judgement come back and lets talk. In both cases i am sure we will never have to talk.

Wike was asked if he was corrupt on TV. His response was “I have not been convicted”. He never said he is clean. He even said I like money. I will trust such a man over a Peter Obi or any one who we know has dipped his hand in the till but pretends to be clean anytime.
