I really pity swore, not because he has used his stupid mouth and braggado to put himself in trouble. But because the usual suspects,the loud mouthed, online mob(Kanu turned Obi supporters) are egeing him on. It's a known fact that anyone they support is doomed and is either going to jail or is going to die physically or politically.

When it'll clear for his eyes is when he's sharing a cell with Kanu in sokoto. He'll learn never to allow the headless mob to support you and better for them to hate and antagonize you.

What is he using it to establish?

It can be used to establish so many different things in law

You can divide those into 2 groups
1. Those that seek to establish that Tinubu does not have a good reputation in public opinion and therefore the statement is not defamatory

2. Those that are not concerned with whether or not the statement is true
Just to say he acted on a REASONABLE BELIEF and GOOD FAITH

It is important to understand the difference between criminal liability and civil liability

In criminal defamation the bar is higher

Need to show malicious intent

He will rely on a claim that it is widely circulated in public discourse that Tinubu is a drug lord and that He Sowore did not start it
IS IT REASONABLE IN NIGERIA TO BELIEVE TINUBU HAS ASSOCIATION WITH DRUG DEALERS AND CRIMINALITY
BASED ON INFORMATION IN PUBLIC DOMAIN
I am sure apart from Omokri he can find over 20 such statements
He can spend one day presenting each one ad nauseum till the court says enough!

The other thing is once it s admitted Tinubu may need to disprove it
Tinubu is unlikely to appear and that weakens the case

This is a criminal matter
It is not enough that the statement is defamatory or false

Tinubu has to show this is more than political speech which he himself has engaged in
