Customer Sues Opay, Says Account Restriction Led To Father’s Death by Newsextra014(op): 9:20pm On Feb 08
Opay Digital Service Limited, one of the fintech mobile money firms operating in Nigeria, has been dragged before a Federal High Court in Lagos by one of its depositors over the alleged unlawful freezing of his account.
The applicant, Moses King, claimed that the action led to the death of his father.

King instituted the suit against Opay Digital Service Limited through a Fundamental Rights Enforcement Procedure pursuant to Section 46(3) of the 1999 Constitution of the Federal Republic of Nigeria.

In the suit marked FHC/L/CS/178/2026, filed by his lawyer, Barrister Olalekan Ogunbunmi, the applicant is seeking several reliefs against the fintech company.

He is asking the court to declare that the freezing of his account, number 8087652738, from September 17, 2025 to December 9, 2025, without a court order or just cause, was illegal, wrongful, unconstitutional, and a violation of his fundamental rights.

King further argued that the restriction prevented him from accessing N500,000 meant for his father’s hospital bills, which he said resulted in his father’s death.
Among the reliefs sought are:


A declaration that the account restriction violated his constitutional rights.

A declaration that withholding his funds without lawful authority was illegal.

A declaration that the restriction directly contributed to his father’s death.

An order directing Opay to publish a public apology in two national newspapers.

Payment of N50 million as exemplary damages.

In a 23-paragraph affidavit supporting the application, King stated that he is a trader who has long operated the account for legitimate business transactions.

He said he discovered on September 17, 2025, that he could no longer carry out transactions on the account. After contacting customer service, he was informed that a Post No Debit (PND) restriction had been placed on the account.


According to him, the company allegedly failed to provide any court order authorising the restriction and only told him he needed a court order to regain access.

He added that repeated visits and inquiries yielded no explanation.

King said his lawyer later wrote to the company requesting either removal of the lien or provision of a court order. However, he claimed that the company admitted there was no court order and that the restriction was based on an internal bank report.

He stated that the funds in the account were specifically meant to pay his father’s hospital bills, but the restriction left him unable to access the money.

“That inability to access my personal savings account led to the death of my father because I could not pay his hospital bills,” he averred.

He also maintained that he has never engaged in fraudulent transactions and described himself as a law-abiding citizen.

The applicant further alleged that the restriction caused him severe hardship, forcing him at some point to rely on neighbours for food.


Opay Digital Service Limited is yet to file a response to the suit despite being served with the court processes.

Justice Daniel Osiagor has fixed March 2 for hearing of the case.

What was the reason for the PND?
Opay must have disclosed the reason to him him, either justifiable or not
Probably his account was used to commit fraud or a depositor reported his account due to business disagreement

I can attest to this.
I had to threaten them to report to CBN before they did the needful on my case.
I have 2 Opay account, 1 is active while I rarely used the other.
I have an habit of checking all my inactive bank account once in a while to know their status. On this fateful day, I logged into the inactive Opay account, saw a deposit of 100k, but reduced to #99,850 due to bank commission #100 and stamp duty charges #50, with the account having a restriction. Checking for the sender details, it's an unknown sender, checked the reason for restriction, it's because the fund was flagged due to report from the sender.
I clicked of the reversal process, but I couldn't submit it because the available fund is now less than the amount received due to the charges. That's how the back and forth with customer support started, which lasted for about 2wks.
I was like, why would you placed an account on DND for 2months for erroneous transfer without reaching out to the account holder since he needs to grant an approval for reversal. Okay, I'm interested in refunding the fund, can you pls reverse it back, they said no, I have to pay the #150 shortage, I was like why do I have to bear responsibility for the sender error or company deduction. We dragged it continuously for days, then I had to accuse them of stealing customers fund and that's the way they must have been doing to other customers. I noted the name of the last support staff I spoke with, told her I was going to report to CBN officially, she called in her supervisor to attend to me, I noted her own name to and repeated the same line, immediately after the call, one of them sent #150 to my account and I successfully submitted the reversal request.
This process took me 2wks and few days.

So sad. Sorry for his loss.

It will be very difficult to prove if the progression of the event that led to the death had no direct link to Opay activities.

It's like suing IKEDC for power outage during a fatal surgery. IKEDC wasn't the one that caused the disease to worsen to the stage it requires surgery and the procedure doesn't fall under direct control of IKEDC decisions.

mine was during Nin linkage issue with palmpay. I later leave the account for them with my 7500 inside no stress.

Bank has power to place your account on DND under certain circumstances under CBN rule, I don't know the extent of the power, but I know it's not infinite, as that of a court order. So while they are at it, they need to get a court order for the account to remain under the PND.
Also, if your account is having a kyc issue, the bank don't need a court order, they place it on PND.

If he reach your turn praise your oppressor. It is hs hard earned money and denying him right to the money violate his human right. If they feel they don't want him they could have just called him to move his money to another bank
