The only person that I feel sorry for is Obi who already had a brand in Labour Party joining you guys in ADC. By now Labour party wuld have made a big inroad maybe even get Kwankwaso onboard as potential VP in LP.

The factional chairman of the African Democratic Congress, Nafiu Bala, has dismissed as fake a resignation letter purportedly attributed to him, describing it as a fraudulent creation by desperate political actors.

In a statement issued on Sunday by the Director of Media and Public Affairs in the Office of the National Chairman, Dr. Christopher Okechukwu, the party said the document dated May 18, 2025, was neither authored nor signed by Hon. Nafiu Bala and lacks the official insignia of the ADC.

Okechukwu emphasised that Nafiu Bala has not resigned from his position and continues to lead the party following due process as stipulated in its constitution. It further described the fake letter as a desperate ploy designed to destabilise the party.

He said, “The National Leadership of the African Democratic Congress under the legitimate and constitutionally recognized Acting National Chairman, Hon. Nafiu Bala, hereby issues this statement to categorically deny the existence of any legitimate resignation letter from Hon. Nafiu Bala and to expose the malicious plot engineered by former National Chairman Chief Ralph Okey Nwosu and a coalition of power-seeking elements attempting to hijack the party’s structures through undemocratic means.

“The ADC emphatically denies the authenticity of a resignation letter purportedly authored by Hon. Nafiu Bala and dated May 18, 2025. This document is entirely fabricated, fraudulent, and maliciously circulated by certain mischievous elements within and outside our party seeking to undermine the ADC’s constitutional leadership and sow discord among our members.

“Hon. Nafiu Bala has not at any time resigned from his position as Deputy National Chairman of the ADC, nor has he relinquished his leadership role following the legitimate transition processes outlined in the party constitution.

“The fraudulent document, which lacks official party letterhead, emblems, or insignia, represents a desperate attempt to create confusion and destabilise the party’s operations.

“Constitutional Leadership Transition Process: The ADC affirms that according to our constitution, any individual seeking to assume a leadership position must. Be a registered member of the party for at least one year. Maintain current financial obligations and membership status. Follow due process in leadership transitions.

“The ADC leadership has identified a coordinated effort by a coalition of power-seeking individuals, including former National Chairman Chief Ralph Okey Nwosu and certain external political actors, to illegitimately seize control of the party’s structures in violation of constitutional provisions.

“This group has attempted to submit unauthorised documentation to the Independent National Electoral Commission, including the fabricated resignation letter, as part of a broader scheme to undermine the ADC’s legitimate leadership and impose unelected officials who do not meet constitutional requirements for party leadership.”

He called on the INEC to reject any unauthorised documentation and recognise only Hon. Nafiu Bala’s leadership.

He added, “The African Democratic Congress calls upon INEC to reject any unauthorised documentation and recognise only the legitimate leadership under Hon. Nafiu Bala. Party members nationwide are to remain vigilant against misinformation campaigns.

“The general public is to disregard false claims about party leadership changes. Law enforcement agencies are to investigate this attempt to undermine democratic processes.

“The African Democratic Congress under Hon. Nafiu Bala’s leadership remains the legitimate, constitutionally-recognised platform committed to Nigeria’s democratic development.”

He urged stakeholders to reject the desperate attempts by power mongers to destabilise our party and instead join us in building a stronger democratic future.

Today, Nafiu has been expelled. A Party is supreme over its own affairs. The man resigned, a NEC meeting was held, INEC was present and the formal handover of activities took place..... A NEC meeting, yet Professor of Law has now interpreted ante bellum in his own way.

Like I said, we have seen this before. The worst institution hit by Tinubu's ascendancy is the Judiciary, it will take years to right the wrongs.

It's finally going to be a coronation and not an election, so INEC share the money and give me my own cut.
i strongly believed inec has legal team and would have consulted well before reaching that decision. for me its simple, talk to the other man to withdraw the court case or ADC sue INEC on this

1. The man can't be spoken to.
He has his paymasters. That window is shut, he was publicly expelled by the ADC in Gombe in August. How can you talk to an expelled member?

2. We have seen INEC do what they do many times. This sam INEC on Monday affirmed Mark to go on with the National Convention and yesterday, on their prompting has done another thing.

3. Any suit they go ahead to file will refer them to the Primary suit already at the Federal High Court.

4. The decision of handing over to Mark was a NEC decision in the presence of INEC who acknowledged same, that is binding and final.

5. The Appeal Court did set this up for good reasons. It is an interlocutory appeal, so going to the Supreme Court will still get same outcome.

6. It has every backing of the President, he wants to run alone in 2027.

INEC and the ADC Leadership Dispute: Legal Obligations Under Status Quo Ante Bellum

The genesis of INEC’s position in the ADC leadership dispute traces back to the NEC meeting of 29th July 2025, which produced a new leadership led by David Mark following the purported resignation of the Ralph Nwosu-led executive.

However, Hon. Nafiu Bala Gombe, who denies resigning as Vice National Chairman, approached the Federal High Court Abuja claiming entitlement to the chairmanship. He sought to restrain both the David Mark-led executive and INEC from recognising the new leadership, filing a motion ex parte and a motion on notice for an interlocutory injunction ante bellum.

Rather than granting the ex parte application, His Lordship, Hon. Justice Emeka Nwite rightly ordered that parties be put on notice. However, instead of responding on the merits, the David Mark-led executive filed an appeal challenging that decision, an action that has significantly contributed to the present legal impasse.

In its judgment of 12th March 2026, the Court of Appeal dismissed the appeal of David Mark led executive and made a clear preservatory order:

“Parties are hereby directed to maintain the status quo ante bellum and shall refrain from taking any step or doing any act capable of foisting a fait accompli on the court or otherwise rendering nugatory the proceedings before the trial court.”

This order admits of no ambiguity. Status quo ante bellum means a strict reversion to, and preservation of, the state of affairs as it existed before 2nd September 2025, when the suit was instituted. It is a binding command prohibiting any alteration of the res.

The Supreme Court has settled this position in A.G. Federation v. Abubakar (2007) 10 NWLR (Pt. 1041) 1, holding that parties must not take steps capable of prejudicing pending proceedings or presenting the court with a fait accompli. See also, Kotoye v. CBN (1989) 1 NWLR (Pt. 98) 419 which affirms that such orders are meant to freeze the legal and factual situation pending final determination.

Against this legal backdrop, INEC’s position is not discretionary, it is compelled by law. Faced with conflicting demands from both factions, the Commission is bound by the subsisting order of the court, which imposes a superior legal obligation.

Accordingly, INEC has taken the only lawful course: it has refused to recognise any faction of the ADC, declined to monitor or participate in party activities, and moved to remove names uploaded after the institution of the suit. Any contrary step would amount to a direct violation of a binding judgment of the Court of Appeal and a grave affront to judicial authority.

The law remains trite: no party can, by unilateral action, overreach the court. Until the Federal High Court determines the substantive dispute, any purported leadership outside the pre-dispute structure is a nullity, void, ineffectual, and dead on arrival.
