Court Orders OAU To Correct Student’s Degree, Awards N5m Damages by peekspot(op): 11:00am On May 05
Justice Adefunmilola Demi-Ajayi of the Federal High Court sitting in Osogbo, Osun State, has ordered Obafemi Awolowo University (OAU) to correct the degree classification of a graduate, Shekoni Jemima Oluwagbemisola, after finding that the institution unlawfully downgraded her result.

The court, in its verdict, held that the university breached and violated the fundamental rights of the plaintiff by changing her grade from “Pass with Credit” to “Pass” without lawful justification.

The court consequently awarded N5 million in damages against the university, alongside N800,000 as the cost of the suit.
Oluwagbemisola, a graduate of Physiotherapy who earned a Bachelor of Medical Rehabilitation (B.MR) in 2023, had approached the court in Suit No. FHC/OS/CS/107/2025, challenging what she described as the arbitrary alteration of her academic record.


Filed through her counsel, Princewill Okoroafor of P. O. Okoroafor & Co (The Daniels Chambers), the suit stated that the university initially confirmed her academic standing as “Pass with Credit” in a Statement of Result dated November 23, 2023.

The classification was also publicly affirmed during the institution’s 47th Convocation in December 2023, where she was listed in the official convocation brochure as graduating with the same grade.

However, trouble began when the plaintiff applied for her original certificate, only to discover that the university had revised her degree classification to “Pass”.

After unsuccessful attempts to resolve the discrepancy internally, she sought judicial intervention.

While delivering judgment, Justice Demi-Ajayi described the university’s conduct as “arbitrary and reckless”, noting that it failed to adhere to acceptable standards and best practices expected of a reputable institution.

The judge further faulted the university for failing to publish the plaintiff’s final year results and for neglecting to properly investigate the alleged error before altering her grade.

Having found that the university breached, violated and infringed on the fundamental rights of the applicant by unlawfully and illegally changing her grade from ‘Pass with Credit’ to ‘Pass’, the court holds that there is no doubt that the illegal and unlawful action of the defendant must have caused the applicant great inconvenience and hardship,” the judge held.

The court added that such conduct, which shows disregard for the law, warranted the award of exemplary damages.

Justice Demi-Ajayi also referenced the appellate decision in Okafor & Anor v AIG Police Zone II Onikan & Ors (2019) to support the award of damages in cases involving abuse of rights.

The court declared that the university is legally bound to issue the plaintiff’s original degree certificate reflecting the correct classification of “Pass with Credit”, in line with its earlier publications and official communications.

It further held that the alteration of the result had caused significant disruption to the plaintiff’s academic and professional pursuits, noting her unchallenged evidence that she had already used the earlier result for postgraduate applications.

The court found that a reasonable person would conclude that the plaintiff suffered emotional and psychological stress as a result of the university’s actions.

Accordingly, the court granted all the reliefs sought by the plaintiff, including orders directing the university to issue a corrected certificate consistent with the decision of its Senate, which had approved her result on November 20, 2023.

The late Gani Fawehimi, l think he had a 3rd class degree in law but today, his Law journal and input is been referenced in the legal system ooooooooo, 3rd class or pass with credit or pass is not the issue but allowing all you learnt in school to translate into critical thinking skills to proffer solutions to the problems of humanity

As long as you are solving the problems of humanity, money, jobs etc will pursue you oooo but that is not down playing the place of higher grades in school ooooo mucheche Hahaha 😂

3rd class,

This is the crux of the matter.
Some institutions believe they're infallible.
A simple issue of error that could be amended within a Senate siting and nobody would even know about it. They must do agidi.
I'm sire they were surprised at lawsuit coming from the student. I can also imagine them scrambling to settle out of court but the student refused.

I'm surprised too, never heard of Pass with Credit, this is the first time.

Please I also want to ask, is there any hope of PGD for one that graduated with a PASS?
Because I heard only Third Class can be accepted for PGD

O.A.U should pay through the nose for the emotional and psychological distress she went through.
I graduated with a third-class according to what is on my statement of result. I haven’t gone back for my certificate because the university system failed me. Never really used my course of duty to work even though I’ve worked in different sectors, applying the critical-thinking and problem-solving skills acquired through education and continuous self development courses.

A big kudos and congratulations to the said girl, her lawyer and parents for such a brave undertaking because I’m just imagining the level of shaming and ridicule she must have been subjected to while trying to correct the error internally with the University board. I’m sure they must have said things like “you graduated with such an abysmal grade and still have the gut to call for correction” or “what’s the difference between this and pass with credit?”😂😂
An institution like this shouldn’t be trusted. If Nigeria was a working society, external moderators would be called in to audit the entire school’s academic activities over the years because they can do worse if changing of an ordinary error could become rocket science. The institution must be put under strict scrutiny by external authorities. The “pass with credit” should even be reviewed further or maybe her whole transcripts, tests and exams should be carefully audited (including those of her classmates)

This isn’t a mistake. It’s a common, wicked practice especially aimed at postgraduate students who come from other universities and dare to outperform their own graduates.

I know because I was a victim of this barbaric act. During my master’s program in the same OAU, I was on track to graduate with a distinction. But before releasing the results, the sadistic lecturers would hold a meeting just to decide how many marks to deduct from my score before making the result public

Thankfully, one student had all the hard evidence and took them to court. And justice was served.

Most responses here show the low level of knowledge of most Nigerians, even those who attended higher institutions. Most are saying that they are only aware of grades like First Class, Second Class, etc. They don't know that Medical Students are not graded that way. There is no First Class or Second Class, etc, in Medicine & Surgery and some allied courses.

I totally understand what you went through because I also went to a federal first generation university for my first degree and masters. They made our lives hell on earth just because we dared to apply for university education

You are the one who seems not to know the grading system

Her course was not Medicine and surgery. Only medicine and surgery is not graded

The other courses in faculty of medicine apart from Medicine and surgery are graded like all other courses.

She would be graded but the pass with credit will be included in the certificate.
