Mistermoon:You have to determine your type off tenancy and also if you have any landlord-tenant agreement that may override tenancy laws/provision. If there's no such agreement, and you're a yearly tenant, you are entitled to 6 months notice to quit. Also your landlord can give you a quit notice for any reason he likes. It’s really unfortunate how quickly people jump to conclusions without paying attention to the actual details. Though, manner of approach matters. He has legal right to electricity power supply in the compound. Second, the landlord does not have any legal right to chase him out of the property as far as he's not violent and his rent is still running. The only caveat here is that, the landlord must be ready to payback the prorated rent at the point of exiting the house if he must leave. You can't take some's money and chase him out in the name of being a landlord. (Who born you). If you can't entertain a tenant, settle out with him and pay outstandings let him go. No tenancy law treats a tenant as second class. In fact, the law is slightly skewed in favour of the tenant. |

Bimboscoo:Thank you. You are the only sane person I can see here. It's like those supporting the landlord are also landlords themselves. Even if you're one, you can't be a landlord everywhere you go. The injustice you support today will surely comeback and hurt you. The man has every right to confront the landlord to settle out the power issue, which they are facing in the community as the only compound without light. If his rent is still running, the landlord must be very careful not to break the law. Either prorate the rent and pay him the balance as at the time of leaving or wait till the tenure elapses. I can see many ignorant people here responding without experience and knowledge of the matter.. |

In my earlier comment I said I have been to Mediation Centre twice and know what transpired then. The tenants spent more than 6 months. I know my experience in another place where I mistakenly rented. The environment, house and the type of Landlord matter. |

He's asked him to leave - that's what quit notice means - of course he'll refund the outstanding rent if said tenant has before quiting. About legal legal legal.... This is a civil matter, common sense demands that OP explore dialogue or get an intermediary before spending money that can be used for personal matters to pay lawyers, after which the court either enforces the quit notice amd have the landlord refund outstanding rent, or ask the landlord to fix the light. But if the court forces his hands, guess who will still be sent away from the house after his rent expired? The Legal-battle-loving tenant. |

People pls read the 1st page to understand the matter. The issue here is the tenants demanding landlord pays for contribution to buy transformer after his light was cut. Landlord does not want to go to court on that. But tenants says landlord MUST pay. How? Please read well and stop all this. I am also a landlord. No landlord can ask you to leave 30 days unless your rent has expired and or due for renewal. Tenants wants landlord to pay for Transformer instead of dialogue. How. I spoke to my tenants when our community proposed buying a transformer. I can't force them to pay but I can tell them the implications. And I can also let tenants know that I will not renew his rent giving him the 6 months notice ahead. If rent is not expired he should leave at the end of his rent. |

Google Nigeria tenancy law; you will discover this: biannual 3-month notice, annual payments, 6-month notice to evict. Despite that, when the notice expires, the court will still grant a one-month grace period to be evicted, so you don't even need a lawyer unless you want to live longer and have to battle long litigation. No court will grant 30 days' quit notice in Nigeria. The court will invite you when the matter is ongoing, and your receipt will be viewed in regard to your quit notice duration. My professor, the law is the law. While the landlord was hash, he will easily win this case any day any time if you go to court. It is not the duty of any landlord to buy or to contribute for a transformer, transformers belong to the service provider (Disco). I have contributed in the past but declined joining fellow residents to go for disconnection, when they did, the disconnected residents who know their right were reconnected after approaching PHCN Marina and we just took it as a loss. You can't force them; it is not their fault. The landlord doesn't even own the disconnected prepaid meter; it is under the management of the disco once connected. Every connection from the meter to the Disco infrastructure can only be touched by the Disco, you can verify this from NERC or a PHCN official Back to the issue of quit notice. Emotion or sentiments aside, how will she/he win in court? .....No matter how long the case last and he/she gets a favorable judgement, he/she will still have to pay the rent within that period in addition to the legal fee (unnecessary expense). If she loses, she will still pay the accrued rent, legal fee and new agreement/agency for the new house she will move to. So, tell me how she will win without losing more money? The landlord will easily recoup his legal fees from the next tenant simple. Mind you, she didn't tell you what reason the landlord stated in the notice letter, I am sure he won't be stupid to reference the PHCN altercation. You can petition the association and push for reconnection as long as that transformer has been handed over to the disco and energized, they are losing money by having you and other tenants disconnected, that is the easier battle. professorPABX: |

Oracleee:I believe we need more people like you. But honestly, what can an ordinary person do in a situation like this when the judicial system is corrupt? Someone who tries to take the legal route could end up being blamed or even imprisoned if they’re not careful. We really need to start speaking up and writing to our leaders without fear, demanding accountability. Take NEPA for example, despite paying regularly for electricity, they still operate anyhow they like, forcing payments under threat of disconnection. If you protest, they can cut off power to your entire area until people are forced to go and beg them. What has actually been done about this? Bro, I truly understand your point. But we all know how the Nigerian system works. If you’re not financially strong or don’t have connections in high places, you may regret taking legal action over something that an ordinary “ I'M SORRY” could have resolved. |

Kingkendrick109:I am a member of an Estate Association and also a CDA member in different places. I only read few things from your long epistle and stopped. I never wanted to reply because it is out of context but for what I am experiencing as a tenant in another place I will say few things. All the issues of transformer, DISCO and the Community Development Association have nothing to do with the tenancy agreement between tenant and Landlord. It is the Landlord that is a bad member of the CDA. The issue between CDA and Landlord is not for tenant except he is delegated by the Landlord to do so on his behalf. The issue at hand is between Landlord and the tenant. I have been to Mediation Centre twice . I was there when they were at Motorway Building, 7up and now at Alausa. The tenants spent over 6 months. None of my tenants can endure darkness while other houses have light. I cannot also leave them in darkness while others have light. As usual, in that Estate, there are Landlords that contributed much than normal for facilities in that Estate. My Landlord and the Agent at the place where I am a tenant can do worse than his landlord. Few months ago I just paid 2 years security dues to the CDA. I was the only tenant in that house that has paid 2024/2025 and 2025/2026 security dues. Forcefully, I retrieved the money from the Landlady and paid after harassment at gate by CDA security members over the money I paid together with the rent. I cannot and can never treat my tenants that way. For retrieving the money I am not on talking term with the landlord and the agent. They burdened tenants with so much responsibility and never fulfilled any of the promises made before payment. That is why I said it is because of poverty. There are some tenants you cannot try nonsense with. Also, there are Landlords that are too refined and urbane to behave like a crude and uncivilized people. The only thing the Landlord could have done is to plead with tenants to contribute money to settle the CDA for the transformer while they deduct it from their next house rent. He cannot leave them in darkness because he is fighting the CDA of the place he built house. |
