Non immigrant visas still exist for exchange, fellowships, research etc. What they're saying is, if you want to change to immigrant, return home to process. All these info are in the public. Part of the conditions of non immigrant visa is return home after your program. Non immigrant Visa policies robustly cater for all these nonexistent excuses you're raising.

There are other visa categories to take care of real talents. Once again, they have relatively nothing to lose. Ever since the visa ban and freeze, what have they lost? What did they lose in his first tenure of immigration tightening?

The angle I expected you to be arguing from would be the revenue loss, sweeping ban/freeze affecting at least 91 countries (which is like asking affected people to return to consular offices that have been halted), or the common cliche that USA is a country of immigrants bla bla. I really need that USA bit due to their harsh immigrant policies i will go to Canada for now, I'm a Pharmacist based in Nigeria and hope to practice Pharmacy in Canada. What jobs do you suggest I should easily settle in with in Canada before practicing as a Pharmacist in Canada?

Why will someone on H1B return to their home country? AOS is in the law and there will continue to be AoS. This is not a new law but a reminder to applicants and USCIS officers.

They reinstated and “reminded” applicants and USCIS officers that discretion has been written into the law, and a lack of discretion has caused fraudulent patterns in some areas, therefore they are now going to exercise their legal right to discretion more in depth than before.

They did not eliminate legal AOS, no new law has been made, no major changes have been enforced in black letter policy. They basically said “We see the patterns, we’re going to make fraudulent patterns harder to achieve… and we are telling you this now, so it doesn’t come as a shock”
