The judge, who ordered the company to change its name to another distinct name without the use of the word, “Naira,” also gave an order of perpetual injunction restraining the firm from parading itself as the registered proprietor of the trademark “eNaira.”

This judgement can affect "Nairaland", Naira Marley too. And any registered name with Naira in it.
I suppose Raheem Sterling, Creflo Dollar should be worried too?

Yeah, you are making some sense here. But I like to believe the owners of eNaira were being overconfident and unrealistic about what would be the outcome of the judgement otherwise they should have been the one asking for out-of-court settlement knowing that CBN has a upper hand in the case because of the name 'Naira' they are using there.

The Judge is right to make those observations. The judge is however wrong to make eNaira payment solutions pay damages to Cbn.

Cbn should have been made to pay compensation to him as the first and legally named user of the portfolio and afterwards they retract the name from him. That way no hard feelings.

This should’ve been an out of court settlement where all parties quietly resolve things

It is the company's lawyer I blame. The work of a good lawyer is to guide clients to act within the law.
The issue must have been long dragged before been official. Registration a company is different from trademarking a name. Problems arose when he wanted to personalize public asset. If he successfully trademark it, it becomes illegal for anyone including government to use the name.
You are treated rightly by been officially written to change the naira in the name, instead of compliance you sue them claiming huge damages.
Where is the lawyer professional counsel here?

Our lawyers should be doing better please.

What affected the company is the nature of business the company does, if it doesn't have to do with money related matters, the name would not have mattered I guess.
This here is the issue.
I see some mentioning Nairaland.
NL can't be affected by such as it's not into financial or economic trade.
The company was fined not for the name registration, but for bringing up a trademark case against the CBN when it wasn't having a trademark on the name.
There is difference between company name registration and trademark registration, so it actually instituted a suit on both against CAC and CBN

The judgement debt isn't for the company name case, but for the trademark case.
Its trademark wasn't granted, so he went ahead to sue cbn for damages over the trademark which was what led to the fine.
The judgement on company name was just for him to get another name, there was no fine in respect to that

You are right about the out of court settlement but who knows if they were overconfident, they might have felt threatened by CBN's imposition or they were just trying to defend themselves from corrupt actors in the CBN/govt from demanding some sort of bribery. We can never know the underhand dealings.

What's sad is how they have to pay for damages which in my opinion is very wrong. Its unfair to register a company and pass through the stringent procedures, intended profit margin or losses valuations, taxes, expenditures over the years and either be made to revoke same name without proper compensation while being asked to pay for damages over trademark rights when there's no case of financial fraud.

Justice seeking should not be a weapon of the government against the common man.

In the amended suit filed on 5 April 2024, the plaintiff brought 17 prayers including a N90.10 billion in damages.

It prayed the court to restrain the defendants from withdrawing the trademark, “eNaira,” from it and stopping the CBN from claiming or conferring ownership of the name on itself.

It described the acts of the defendants as unconstitutional takeover of its personal property which it had maintained for over 20 years, among other reliefs.



This means the company in quote already owns the trademark and the CBN are the ones sorting to removing the trademark.

Even the judge in this:

Delivering a consolidated judgement in the suits, Justice Omotosho observed that the Trademark Registry, through a letter dated Nov. 15, 2021, had written to eNaira Ltd canceling and withdrawing the acceptance letters issued to the company in respect of applications for eNaira in class 36 and 42.

He observed that the registry had directed for the withdrawal on the grounds that “eNaira is a national intellectual property and constitutes a symbol and national asset of Nigeria.”



Notice the judge is saying yes they have and own it but According to the judge, as it stands, the plaintiff has no greater legal right to the trademark than the 1st defendant.


This simply means both arms of government can disenfranchise any common man if they decide that 'a name' as such meets the interest of government



He should've been compensated out of court
Not only is he being disenfranchise because the name meets government interests
He is also being asked to pay for damages

No, an application was made with an acceptance issued but was withdrawn
The application would not have been rejected if there was an approval already, also, an application wouldn't have been pending for about 15yrs if it was registered already, what would have been withdrawn was the trademark licence/approval.
The company with the way the report was written, applied for a trademark probably when the enaira project came up (take a look at the timeline) because they have a registered company name already, a letter was written to them to change the name but they refused.
The Trademark Registry is yet to issue a Trademark Certificate to the company, until such is issue, you don't have a trademark yet, the CBN probably got to know about the trademark through the Acceptance publication, then informed the Trademark Registry which revoked the acceptance and sent the company a revocation letter instead of a trademark certificate
Also, it's not a case of bullying, if you are familiar with business law and company law, you will know they were wrong, there are precedents against it, even if you find a way to register a company that is under an exclusive name list, whenever such infraction is noticed, you will be called upon to change the name, if you refused, the law will have to come in
