Ordinarily I would have been happy with the deregistration of ADC because it would clear the pathway for the north to vote for Peter Obi in greater majority, but I can’t support injustice just because it favours me or my interests.

The High Court based its ruling on the constitutional provision that INEC has the power to deregister any political party that fails to either score 25% of votes cast in any state in a presidential election or fails to win the governorship, senate, HOR, House of Assembly or LG chairmanship.

However, records show that ADC won 2 House of Representatives seats in the last general election.

The ADC won two House of Representatives seats in the 2023 National Assembly elections. Those seats were:

1. Leke Abejide — representing Yagba Federal Constituency (Mopamuro, Yagba East, and Yagba West LGAs) in Kogi State. He was re-elected on the ADC platform.
2. Ahmed Jaha — representing Damboa/Gwoza/Chibok Federal Constituency in Borno State. He was listed among the two ADC members elected into the 10th House of Representatives.

Further breakdown of parties and the number of seats won is as follows:

In the 2023 Nigerian House of Representatives elections, the African Democratic Congress (ADC) won 2 seats in the House of Representatives.

The distribution of seats after the election included:

* APC – 162 seats
* PDP – 102 seats
* Labour Party – 34 seats
* NNPP – 18 seats
* APGA – 4 seats
* ADC – 2 seats
* SDP – 2 seats

So, on what basis was the party deregistered despite this obvious record of electoral success in the last election?

I know APC supporters are cheering the news but you should be careful what you support. These things are setting precedents and the people you support will not always be in power. I hope you would be okay when another side gets into power and starts to follow in same footsteps.

This is an aberration that should be reversed.

They have engaged the services of multiple polling firms and analysts that keep telling them that Tinubu has no pathway to re-election. Hence, the desperation you see. In law, this is called fait accompli.

Not only does the ADC have elective positions, the ruling was given in defiance of a court of appeal judgement that had ordered the matter to not be heard until November. Tinubu and Wike are in panic mode and this judgement was meant to erase news of Amaechi's selection as Atiku’s Vice. Just as the Nafiu Bala fiasco by INEC was done on the day Kwankwaso joined the ADC. The incoming government will have a lot of sanitation to do beginning from the judiciary.

What I find confounding is that Justice Lifu is no longer pretending about how sold out he is to injustice and in doing the bidding of Wike and APC.

It’s so so annoying and embarrassing
Well, if he has been mobilised with more money than he can ever get to make in his career as a judge and he has no conscience, he will be willing to do whatever his paymasters asks of him. It's just a shame that taxpayer's money saved from the sweat of struggling Nigerians is being channelled to the wrong cause while Nigerians are left to grapple with insecurity and maladministration.

I’ve never denied Leke’s membership of ADC.

Our contention has been that in the spirit of party supremacy, he was supposed to simply abide by the new leadership of his party after new leaders were appointed by virtue of the coalition.

The provisions of Section 225 of the Electoral Act grants INEC the power to deregister political parties for not meeting some requirements. It does not mandate INEC to deregister them. It is at the discretion of INEC to exercise the power. That much should have been clear to Justice Lifu before he engaged in judicial rascality to mandate INEC to deregister. Such judgments can only bring the judiciary into disrepute.

They are not required to meet all, just one of those requirements is enough.
