In reaching its decision, the federal high court agreed with the Peace Movement Party that NDC copied its logo that it had already submitted to INEC. The court thereby set aside its previous order. INEC may register a symbol only if: no identical or substantially similar registered symbol already exists; the symbol is distinctive; it is not offensive or prohibited by law. It does not expressly state that merely filing an application years earlier automatically creates a proprietary right against every future applicant. What the court accepted, at this stage, was PMP's argument that it had a claimed interest in the disputed logo and that, because of that claimed interest, it ought to have been joined as a necessary party before the earlier judgment directing INEC to register NDC was delivered. On that basis, the court set aside its previous judgment and ordered that the matter be heard afresh with all necessary parties before it. Whether PMP actually has a superior legal claim to the logo is a question that still has to be determined through the judicial process. That is precisely why NDC has announced it will appeal. Let's argue the law, not invent findings the court never made. |
