They cant charge you for a crime in Kwara when you didn't commit it in Kwara Its like saying eating pork is a crime in Sokoto, I now did a livestream of me eating pork in AkwaIbom, then someone got offended in Sokoto and sends police to me to arrest and prosecute me in Sokoto. That is abusing the law In some cases where Federal law is at odd with state laws, I will assume that the Federal law will take priority. I am not a law so take this last sentence with a grain of salt |

If you write the defamatory words or you publish it via social media and the people in different states access the defamatory content, it is assumed you committed the crime in any of the states. For example if you write a newspaper article in Lagos and it is accessible to the person in Kwara state, he can actually have a ground for action against you. So the question is : If the person decides to use federal police from Kwara state command to carry you like what Afe Babalola did to Dele Farotimi who is resident in Lagos, can Lagos state police foil the arrest attempt? Won't there be confrontation between the different police forces as regards who has jurisdiction? |

raumdeuter:You are missing the point here. The federal police comes from Ekiti with intentions of arresting Dele after which they would charge him to court for criminal defamation. But let's day Dele is a state commissioner in Lagos state and has connection with Lagos state police force. So Lagos police force foils the arrest attempt of Federal police from Kwara state and there's a stand off. Don't you think we will more of such scenarios in the coming days? Shebi na who police fit carry go dem go detain and charge to court? |

BlueRayDick:When that case happened there was no state police only Federal police, Going forward there wont be needs for Federal police to get involved in state matters anymore. If Afe Babalola wants to arrest Dele, Ekiti police will talk to Lagos police to help them pick up Dele and deliver to Ekiti There is a procedure for arrest, if you have a warrant for his arrest signed by a judge, why will Lagos police want to foil that arrest which will mean they are breaking the law We are so used to law breakers that we assume that is the normal thing |
