Father of late Mary Habila rejects autopsy, withdraws probe

Mr. Tanko Habila Wisdom, father of late Miss Mary Habila, has rejected plans for an autopsy on his daughter’s remains and withdrawn from further investigation into her death.

In an Affidavit of Withdrawal filed before the High Court of Justice, Ebonyi State, Mr. Habila, of Sabon Gari Noh, Jaba Local Government Area of Kaduna State, said the family wants the body released for burial without further medical procedures.

The deceased, Miss Habila, a staff member of David Umahi Federal University of Medical Sciences, died on June 27, 2026, in Uburu, Ohaozara Local Government Area of Ebonyi State.

According to the affidavit, the deceased had been seconded to the Federal Ministry of Works, Mabushi, Abuja, where she worked in the Office of the Honourable Minister of Works for about three years before her death.

“That I am aware that my late daughter served as a Personal Nurse to the Honourable Minister of Works and the Minister’s immediate staff, with whom she resided at the Minister’s Guest House in Abuja and at the Minister’s Staff Quarters in Ebonyi State.”

He stated that although the Honourable Minister of Works requested an autopsy to ascertain the cause of death, the family opposed it.

“That while I welcome steps being taken to unravel the cause of my daughter’s death, my family and I will not accept any autopsy on my daughter’s body,” the affidavit read.

“That it is my family’s wish and humble appeal, despite medical and investigative protocols, to leave her body and organs intact, hence this affidavit.”

The deponent further told the court that he does not wish to continue with the investigation and requested the immediate release of his daughter’s body.

“That I also wish not to proceed further with the investigation and further request to have my daughter’s body released to me for burial,” he stated.

“That I will not honour subsequent invitations by the Police or the Court in respect of this case as my family does not suspect any foul play.”

Miss Habila died at the Minister of Works’ residence in Uburu, where she served as part of the minister’s immediate staff.

The Ebonyi State Police Command had earlier said it would engage a pathologist to conduct a post-mortem examination, noting that it was necessary to establish the true cause of death.

The family’s position now contrasts with the earlier stance of both the police and the Minister of Works.

The court is yet to rule on the application for the release of the body.

You're not paying for Autopsy, you're not the one suing Dave Umahi, so what's your loss in all these?
It's the state's expenses and perogative.
When someone dies under undue circumstances, the state investigates the parties involved.

Why will you go spend money, doing affidavit wey nobody send you?

You can't by parental affidavit, end a murder investigation.
It's a fucking free investigation done by the police, not you.

Imagine his audacity to say he will not honour subsequent investigation by the police or court. Apparently uninformed and ignorant of the law. He has no choice regarding most of his assertions and will be compelled where necessary.

His intentions are against public interest and will not stand. Father or not, if you don't want justice for your deceased daughter, the society demands it. The state must proceed with this case.

This is nonsense.

A 26y old just doesn't die suddenly.

An autopsy must be conducted and a death certificate issued citing the cause of death as determined by the autopsy.

Calm down. This didn’t mean the state won’t continue the investigation. Even a father can be a suspect in the death of his child. He can’t stop the investigation.

He simply doesn’t want the autopsy and he also doesn’t want to be involved. Coroner inquiry is not a matter of days, in 5 months they might not have any body to bury. It’s easier to shout autopsy when the body is not your relative.

Besides, who would want the death of their child be a subject of political scandal/controversy in a country where politicians can use anything to score political points

I am also pretty sure he knows of his daughter's lifestyle and doesn't want more of it to come out in public.

Not wanted to comment, but this seems like a pretty straightforward case of her being a habitual drug user, which is why I believe Umahi is confident and pushing for an autopsy.

It's a sad case and I hope our young ladies learn that all that glitters isn't gold.... especially when you get close to these politicians that are ready to encourage your vices.

The position of the law is not subject to the wishes of any individual. Once reasonable suspicion exists behind any death, the police are duty bound to unravel any possible causes and this includes carrying out an autopsy.

For all we know, her father or her family may have been influenced. The minister in whose house she died in questionable circumstances, should be at the forefront of insisting that a full fledged investigation be carried out.

I am pro APC but there is no reason why this case should not be prosecuted.

It is the duty of Police, a family can't and shouldn't stop investigations.
