Yeah it's a discussion forum alright, but you didn't discuss it previously but rather concluded that she would win in court like you're the judge. So go ahead and educate yourself about the requirements for citizenship by birth in SA cos I won't do that for you . That will start a discussion as others will say why Spain will not win. They wouldn't tell him he's not God to know... they'll give their reasons why they think Argentina will win .
Discuss it previously with whom? ...myself? Am I missing something? Argentina vs Spain .. someone enters a discussion forum and says shouldn't says Spain is going to win.

I totally blame Nigerians for embracing this intruder and giving her a platform to contest in the miss universe pageant. She collected the runner-up crown and ran back to her country. Her Nigerian lineage is not clear, we don't know anything about her supposed Nigerian father but we know she has a Mozambican mother who forges identities for a living. She's as much as a scam artist as her mother, I hope she's deported to Mozambique not Nigeria.
You get it. Some of us went against it though. To think that it was some names they removed to input her name..

Her mother is a scammer. You’ll be shocked that her father is not a Nigeria. Look at the name combinations - what is Adetshina? That’s one cooked up name..

Her mother has been found guilty of identity fraud. No matter how hard the girl tries, she can’t be a SA citizen! The mother wey born her into SA is not a genuine person snd lawyers can always use that against her..

I believe If wins or loose this case, she will definitely leave the country.
She's only only trying to secure her SA passport. Don't know how true, but it seems her documents was suspended
Her passport was been withdrawn nah. Her mom used a fake identity to gave birth to her..

I agree, i mean, her identity appears vague especially as her mother allegedly is a forger of passports.

And if really she is born in SA africa by a nigerian father and a Mozambican mother there would have been a birth certificate indicating that and there would be no need for a court case.

Correct! She will lose the case, there are so many children born in SA by different nationalities parents non has been to court to proof their IDs. Why this woman?

You sound as if na you give birth to her in SA, you would be surprised when she loses the case. Apparently her so called mother forged her passport that alone appears suspicious.

You also sound sentimental, sentiments do not win cases in court evidence does.

You think it's easy to suddenly wake up and adjust your entire existence to another society after practically spending your entire first three decades of life growing up in and calling another place home?

If her attempt at seeking legal redress in SA subsequently fails, she's wholely welcome to settle in Nigeria. She'll always be embraced by her maternal roots, irrespective of her mother's alleged misgivings. Whether that sickens you or anyone else, is the internalized bitterness you'll have to live with.

Leepeak:
If I was born in south Africa, as a Nigeria I am aa citize of south Africa their law

No be automatically so, my brother! Under South Africa law, you no be South Africa citizen just because say dem born you for there.

South Africa citizenship law no dey work like America where anyone dem born for their ground automatically becomes a citizen (jus soli). South Africa dey use what dem dey call jus sanguinis (citizenship by blood) plus some strict rules.

How E Dey Work Under South Africa Law
1. The General Rule (Citizenship by Birth)
For you to be South Africa citizen by birth, at least one of your parents must be a South Africa citizen or a Permanent Resident (PR) at the time dem born you.

If your Papa and Mama na full Nigerians (meaning non of dem carry South Africa citizenship or PR when dem born you): You NO BE South Africa citizen by birth.

Dem go treat you as a foreign national who was simply born on South Africa soil.

2. The Special Exception (When You Turn 18)
There is one special path inside their Citizenship Amendment Act:

If dem born you for South Africa,

Your parents no be citizens or PR holders when dem born you,

AND you come live inside South Africa continuously from the day dem born you until you turn 18 years old,

Then when you reach 18, you get right to apply for South Africa citizenship by birth. But e no dey happen automatically — you must apply through their Department of Home Affairs, and your birth must have been registered properly with dem.

Summary: If your Nigerian parents dem no get Permanent Residence or SA citizenship when dem born you for South Africa, you remain a Nigerian citizen. You go only fit apply for SA citizenship when you clock 18 years, provided you stay for SA all through your growth!

A case of chidima the Nigeria beauty pageant

Ah, the case of Chidimma Adetshina perfectly connects to what we just talked about! Her story is literally the practical textbook example of how South Africa's citizenship and identity laws work in real life.

Here is how the whole saga played out:

1. How E All Start (Miss South Africa 2024)
Chidimma was born in Soweto, South Africa, to a Nigerian father and a mother of Mozambican descent. She grew up in SA and entered the Miss South Africa 2024 pageant, reaching the Top 11.
Wikipedia

However, heavy backlash started on South African social media. Many people argued that because of her Nigerian name and heritage, she was "not South African enough" to represent the country on an international stage.
Scalabrini Institute for Human Mobility in Africa (SIHMA)

2. The Home Affairs Investigation & ID Theft Fraud
As the controversy grew, the South African Department of Home Affairs launched an official investigation into her nationality.
Wikipedia

What they discovered shocked everywhere:

The Department reported finding prima facie evidence that Chidimma’s mother committed identity theft back in 2001 to get South African citizenship documents.

Allegedly, the mother stole the identity of an innocent South African woman to register herself and her child.
Scalabrini Institute for Human Mobility in Africa (SIHMA)

Even though Chidimma was just a baby when it happened and was innocent of any crime, because her mother’s citizenship foundation was illegal, Chidimma's own legal claim to citizenship by birth became invalid.
YouTube

Facing massive public pressure, xenophobic attacks online, and safety concerns, Chidimma officially withdrew from Miss South Africa in August 2024.
Scalabrini Institute for Human Mobility in Africa (SIHMA)
Interestingly interesting! Jeeee! I think she will lose the case but she could then apply for an asylum as a stateless person because even her so called nigerian father or origin cannot be traced.

I do agree with you for blaming Nigerians to allow her to take part in the Miss Nigeria beauty contest. Her mother claims to be from Mozambique ... no proof of father's country of origin ..so what proof does she have that she is Nigerian?
I disagree with you that she should be deported from South Africa. She was born in South Africa. Isn't South Africa her country of origin? If you were born in Nigeria ... can you be legally deported? ...save the explanation...yes/no? Let's not be hypocrites. She has done the right thing and will win in court.
there is no hospital proofs of her being born in South Africa. Its suspected that her mother brought her from Mozambique as a child

There is no hospital proof doesn't mean she was not born in SA. Do most Nigerians have hospital proof of birth? No doubt ... she should have some proof of being born in Nigeria ... a birth certificate is basic internationally... but maybe they have other forms especially with such a vast rural population.

Nonsense! Why did she agree to contest as Nigerian when she does not identify as one? Where is her Nigerian father? Where is he from? Her identity forger of a mum decided to give her Nigerian names for reasons best known to her and gullible Nigerians rushed to claim her.

Abeg comot her here with that gender bs card you want to pull. I'm not like you men that would rather twist facts and make men appear the victim. For me, what is wrong is wrong regardless the gender
Busayo Saka has every right as a British citizen just as Chidinma do have rights in SA, if anything happens to Busayo Saka in the UK tomorrow she has every right to seek redress in a competent court of law and so does Chidinma. That doesn't affect their Nigeria roots in any way.

I support South Africa, if they fail to flush out blacks especially Nigerians as they are doing now,
one day theie official status will be same as Nigeria: the most corrupt black nation on earth where corruption is cultural, religious, political, generally accepted as the norm. Where being a decent, rational, honest human being is a shocker!

for any nation to grow in this life you need IMMIGRANTS. Yes the bad eggs will come too which is a con that you have to be prepared for. Immigrants will boost your economy like "kilode". Ask Dubai, US, Canada even the old biblical Egypt of Joseph (where foreigners came to buy corn in famine). It makes nations powerful

south africa is not like Nigeria where records are bad. If she cannot prove that she was born in SA and with her mother circumstances of fake identity. Then SA can legally deport her. What kind of name is chidinma adetsina too . Keep whining

Does she even have any choice other than to learn to adjust and adapt to different environment in another society? Those blood-thirsty, primitive South Africans will end up killing her and there will be no justice for her.

By the way, why did she agree to come and contest for Miss Universe crown for Nigeria if she knew she would rather die as a South African than live in Nigeria or any other country?

You must read your immigration law very well. This is why we leave such matters to expert immigration lawyers to handle and not uneducated South Africans who are just reading their constitution for the first time.

If its a cut and dry case, She would have been gone by now.

I wonder what her lawyers are arguing are the grounds for her stay in SA.
