ednut1:I don't think there is a dispute currently with her place of birth and as far as her name is concerned you should also be asking what kind of name is Segun Arinze? |

seppuku:South Africa doesn't do birthright citizenship |
| Re: Chidimma Adetshina Heads to Court to Challenge Deportation From S.A (Video) by seppuku: 3:41pm On Jul 17 |
JaceBlaze:You do know that there was a period children born to Legal residents within the country were accorded citizenship by birth right? You do know that children born in the country designated as stateless acquired birthright citizenship right? You do know that there was a clarification of children born outside the country to a South African citizen being "redesignated" as South Africans by birth ( birthright citizenship) and not by descent, right? Like I said leave these things to the immigration experts and ready your constitution properly cause your hate for any other person claiming to be "you" will blind you from common sense. |

JaceBlaze:Its cognitive dissonance. The technicalities too difficult for you. I understand my Brada. That's why people like Jacinta qualify as your leaders. "South Africa does not offer unconditional birthright citizenship; citizenship is primarily granted based on parentage (jus sanguinis), not solely by being born in the country. Current Legal Framework Under the South African Citizenship Act of 1995, any child born to at least one South African parent automatically receives citizenship at birth, regardless of the child’s place of birth This reflects the principle of jus sanguinis (“right of blood”) rather than jus soli (“right of the soil”), meaning that citizenship is inherited from the parents rather than granted simply by being born in South Africa Children born in South Africa to foreign parents do not automatically acquire citizenship. Instead, they may claim South African citizenship later, but only under specific conditions: the child must have been registered at birth, lived in South Africa until reaching the age of majority, and submit a formal application to claim citizenship This process ensures that citizenship is not automatic for children of non-citizen parents. Before 2013, South Africa allowed a form of conditional birthright citizenship children born in the country to at least one permanent resident parent were automatically considered citizens at birth .However, the Citizenship Amendment Act of 2010, effective from January 1, 2013, curtailed this policy. Now, children born in South Africa to non-citizen parents only acquire citizenship if they would otherwise be stateless, and citizenship claims require a formal application after" |

| Re: Chidimma Adetshina Heads to Court to Challenge Deportation From S.A (Video) by seppuku: 5:40pm On Jul 17 |
JaceBlaze:Yes with the key words being "unconditional" versus "specific conditions." This is why laymen who just read the immigration act and constitution for the first time shouldn't be commenting or making sweeping statements. We leave that to the lawyers and immigration experts. |

JaceBlaze:Yes, circular reasoning produces cognitive dissonance. "South Africa does not do birthright citizenship because we just don't do it. on this basis, I declare, you are not a citizen by "birth" Jace. |
| Re: Chidimma Adetshina Heads to Court to Challenge Deportation From S.A (Video) by seppuku: 6:31pm On Jul 17 |
Originalsly:She has grounds to challenge it but there are some aspects of the law that can be argued against her as well. It will come down to the interpretation of the law that governs the "conditions" in which she can claim citizenship. |

seppuku:Oga, listen to me. I don't care if I was born on Jupiter. If I'm no longer wanted in a place and there's every possibility that I could be attacked by angry people, I'll leave without caring how long I've lived there. What Chidimma is doing now is no different from a woman who chooses to remain in an abusive marriage. |

ednut1:Adetsina is a mispelling of the proper name Adeshina or Adesina. The last name is likely from her father or former husband who created a made up identity from Nigeria to enter South Africa as we all know is done. What is mysterious and inplausible about that? |

| Re: Chidimma Adetshina Heads to Court to Challenge Deportation From S.A (Video) by morpheus24: 8:41pm On Jul 17 |
@ednut1 Please understand the mother stole someones ID NUMBER and not the actual wouldbe girls identity. The home affairs official swapped the original with Chidnma particulars thats how Home affairs was able to flag it as a duplicate years later SA ID's are based off dates of birth. |

morpheus24:baba stop making excuses where there is non. If South Africa dont have strong evidence they wont revoke her documents |
| Re: Chidimma Adetshina Heads to Court to Challenge Deportation From S.A (Video) by morpheus24: 10:46pm On Jul 17 |
ednut1:I am simply stating the facts what is making excuses about that? They revoked the stolen particulars now they have to "invalidate" her presence in the country which entails more than just withdrawing documents. I pray she has some good lawyers. I know capetown has some good ones which is why her case should be tried there? Please note that during this bruhaha she was able to exit and renter the country. You don't want to ask how she was able to do that? DId they put South African visa on her Nigerian passport when she was reentering the country? |

She's gonna have to leave the country. It's messed up, but it is what it is. She's young and she has a lot of options in front of her. This won't be easy, but she'll be stronger for it. And SA isn't even a great place anyway. |

seppuku:No doubt... there can be conditions that will prevent her from having full citizenship despite being born in South Africa. But are there such conditions? If there are none .. then she should win her case. If they are determined to deport her ... then they can add the conditions to make them do so legally. PS Just read a comment from JaceBlaze stating there is no birthright law. Interesting ... a game changer to our discussions ... followed it up and came up with this below. My opinion now? It can go either way ... depending on the required evidence she has ... mainly proof of birth ... and proof that she lived in the country continuously since birth. Her lawyer has to know this ... and I guess he has the evidence and is moving forward with confidence. With the mother's shady past .. I can see the problem being if the documents presented as proof are legit. The case can go either way
