What's the maintenance/caution fee forhuh
Re: Who's Responsible For Repairs In A Rented Apartment? Landlord Or Tenants? by oroje1(op): 5:49pm On Sep 07
Thanks... though he has fixed it because I plainly told him I'm no shareholder in his dad's property, and if as he claims the law say so,let him show me,,
bixton:
If you're the only tenant there and like you said, the father when a life was very considerate in such things, then I'll say depending on the amount involved in the repair, you can discuss with the son who is the new landlord to offset a part of the amount on the repair.

But if there are other tenants then, it's better the tenants pull up funds to fix it.
The security of that premises is paramount and the safety of residents witin is most important.
Re: Who's Responsible For Repairs In A Rented Apartment? Landlord Or Tenants? by MasterTeeUSA: 6:09pm On Sep 07
I just asked...if it is getting spoilt every week, should landlord keep fixing it? Gate is not a fundamental structure...it is used everyday by those who live there. Reason I charge service fee...I had this issue...I completely replaced the jam key with brand new, made all new keys and gave it to 13 tenants..did not last 6-9 months, it spoiled. i told them.. you can leave it or you all should contribute...no way will I replace it again and make another 15 sets of keys.

SmartyPants:
Every business endeavour has its own risks. When the landlord lets his property out, he takes the risk of incurring certain expenses, which include structural repairs, particularly where one is dealing with a compound with multiple tenants. What if it is one particular tenant who is fond of destroying the gate? Will it make sense to burden other more careful tenants? Aside from common sense, in any case, this is what the law considers an implied covenant. I.e, it is implied that the landlord should maintain the fundamental structure of the property unless the parties agree otherwise.
Re: Who's Responsible For Repairs In A Rented Apartment? Landlord Or Tenants? by MasterTeeUSA: 6:10pm On Sep 07
Then everyone should decide and contribute...if you continue to burden landlord, he will just jack up the rent...another thing to think about.

My friend thanks 👍 for the info... unfortunately I met the gate like that.

Please o my people, let me call myself a JJC here, I've lived in this apartment for a while now , just over 3 years to be precise, my landlord died recently, but while he was alive even though he was a bit strict, he was understanding and liberal in most of his expectations from us the tenants. Now the son in charge of the he house is something more or less a tyrant, I said so because our gate that has been broken for a while now, the young man said that it's we the tenants that should be responsible for the repairs, that the law of the land says so.... That that's what the law Court syipulates.... So I'm asking, is that true? There may be someone in the house who may know about this so well.
So all of you cannot call welder n contribute to fix the gate

Landlord is only responsible for major remodelling like roofing, fence, soakaway, leaks into the wall etc

Main gates and fences belongs are the responsibility of the landlord.
If the property is exclusively for tenants (i.e the landlord does not live with the tenants), the maintenance and repairs of internal components and gates are the responsibility of the tenants provided they are in good conditions at the time of occupation. However, damages to the roof and fence should be repaired solely by the landlord.

If tenants spoiled the gate it is for them otherwise all external repairs are for landlord. Anything within the apartment is for tenant to fix after tenant has moved in.
what about the repairs of a soak away in a compound where the landlord does not live with them

Ok, let's say you rent apartment and install some fancy kitchen cabinets or other fixtures. Whose responsibility is it to fix them?
U said u installed (that the tenant) hope the fancy kitchen cabinets are not permanent once’s because if they are you need the permission of the landlord to do that and after expiration of your rent you will return back the ones you met in the flat

Now let me assume you are saying the landlord installed fancy kitchen cabinets and it got damaged after you got into the house, since you might it intact (even though it poor quality) it’s the responsibility of the tenant to repair it if damage (even if you have to replace/repair with the same quality of material) but if it a case of the intact but the color as faded or rusty or something of such then it not your responsibility to paint it since it’s intact

Hope you understand

No I don't quite understand. The scenario is, you removed the cabinet there and installed yours with the landlord's permission. Then due to wear and tear it breaks down

this same thing thing happened in our compound.
my ceiling fell off, i call this man, he said it doesnt concern him, i went ahead and do it myself.
the house entrance gate fell off, this man asked every one of us in the compound to pay 2k each to fix it.

then not even upto 6months later, he brought an increment letter of over 50% added to our payment.
this man wrote if you cant pay, pack out.

it is just pure wickedness. you are not repairing your house yet you are increasing rent just like that.
God will save tenants in this lagos.
My former landlord tried that rubbish with me, I locked him up and took over the house

Why do some tenants behave like they lack common sense. If you pack into a house, and the door and lock were intact, when it gets spoilt under your care, it is your duty as the tenant to repair the spoilt door or lock. Or are you waiting until someone enters into the house and steals something before you become wiser.

Same applies to everything used inside your house.

Abi if socket spoil, you go begin call your landlord to come and repair it for you

I currently have same issue. No repairs or new infrastructure but they increased the rent. One of the reasons they gave was everyone around the axis has increased their rent. Though they informed me Feb, against next year but it is just crazy.

if you remove the e furniture, it is best to keep it aside or give it to the landlord, because when you are leaving and they check the house you will be asked to provide it.

You're intentionally ducking the question. The point is, the landlord gave u permission to REPLACE them. Now let’s hear your submission

That is why I gave you two options, you keep the furniture you removed aside, keep it somewhere like a store, so they can replace it if you remove yours or you give the furniture to him!

Fence is their duty.

You guys should be able to fix the gate. Your security is sacrosanct ...except its beyond repair

This issue causes a lot of avoidable friction between landlords and tenants in Lagos, mainly because many people don't read or understand their Tenancy Agreement before signing.
Under Nigerian property law (and specifically the Lagos State Tenancy Law), repair obligations are generally split into two categories unless your agreement states otherwise:

1. Landlord’s Responsibility (Structural & Exterior Repairs):
* Main structure of the building (foundations, external walls, roof leaks, major structural cracks).
* External plumbing, central drainage lines, soakaways, and external electrical mains.
* Pre-existing defects present before you moved in.

2. Tenant’s Responsibility (Internal Maintenance & Fair Wear/Tear):
* Internal fixtures and fittings you use daily (light bulbs, interior door handles, tap washers, damaged locks).
* Any damage caused by your own negligence or misuse (or by your guests).

Key Takeaways to Protect Yourself:

Check the Covenant to Repair:
Your tenancy agreement dictates the exact terms. If the agreement says the tenant fixes structural defects, that's what you signed up for!
Do a Joint Move-in Inspection:
Always document pre-existing damage with photos or videos and get the landlord/agent to sign off before paying or taking key possession.
Never Deduct Rent for Repairs Without Written Consent:
Even if the landlord neglects a major repair, carrying out the repair yourself and deducting the cost from your next rent without written approval can put you in legal breach.

If you're currently renting or looking for a apartment in Lagos, knowing your legal rights and obligations saves you time, money, and unnecessary drama.

I’ve compiled a comprehensive guide covering tenancy laws, red flags to spot before paying rent, deposit refunds, and handling rogue landlords/agents in my eBook: The Lagos Tenants Survival Toolkit.

Feel free to check it out or ask any specific repair/tenancy questions here—glad to assist!

depend on the mutual agreement basically is the landlord but after the renovation you should expect huge increment that's the implication

Okay. That's good, he has fixed it.
I like the way you made him understand the bolded given that the family is also resident in that compound.
We all need to be understanding property owners as well tenants.

It depends, if the gate is good before the tenants moved in and got spoilt at the hand of tenants, everybody in the yard will contribute and repair it. But if it is there before they move in then is the landlord. Landlord can't be incharge of someone else utilities.
