Kenyan court halts construction of Dangote Group’s $16bn oil refinery as locals oppose project

A Kenyan court has ordered a halt to the construction of Aliko Dangote’s $16 billion oil refinery project in the East African country, following a petition by some locals opposing the project.

According to a Bloomberg report on Monday, Jane Onyango, a judge, ordered that “the status quo prevailing” be maintained in Lamu, north-eastern Kenya, where the refinery is planned to be built.

The court, in an order issued on Friday, is expected to give further directions on the case on October 14.

George Wakahiu, a lawyer representing the local opponents, said the ruling means construction of the project cannot begin until the court reconvenes on October 14.

Groundbreaking for the refinery, which is expected to reduce eastern Africa’s dependence on imported refined petroleum products, is scheduled for September 30.

The report said the 133 petitioners, who identified themselves as farmers and residents of Lamu, said the project would infringe on their property rights.

The petitioners alleged that the project involves “forceful eviction of the plaintiffs from their lands, damage and destruction of their properties and yet there is no resettlement plan for them”.

They also alleged that Dangote and Kenyan authorities had not complied with the country’s environmental code, which requires “a mandatory environmental impact assessment be done before the implementation of any major project”.

According to the court filings cited by Bloomberg, the project also fails to comply with Kenya’s constitution, “which requires that the necessary public participation” be conducted.

Reacting to the development, Dangote Group said the Kenyan court ruling would not halt the forthcoming groundbreaking ceremony for the planned oil refinery in Lamu on Wednesday, ‌but that it may affect some site activities.

According to a Reuters report on Tuesday, the group said this is because of the status quo ruling of the court.

“The court has not halted the groundbreaking ceremony of the refinery at this stage,” the statement reads.

“However, activities at the site may be affected by ‌the ruling as both parties are required not to carry activities until the case is heard on 14th October.”

The planned refinery is part of a multibillion-dollar infrastructure project known as the Lamu Port-South Sudan-Ethiopia transport corridor, which includes railways, pipelines, a power plant, roads, and airports.

Na the next generation go liberate africa.

Although in this case it's typical for humans to wanna fight against anything that directly infringes on the source of their livelihood it doesn't matter if it benefits society or not neither is it perculiar to Africans.

Sounds fair to me.

Note that similar things happen all over the world. And here in Nigeria, oil companies routinely compensate communites ...it's even part of the production costs of crude in Nigeria...

Plus, una know how much Lagos paid land owners and residents for the land in Lekki free zone where Dangote nigerian refinery is? A lot of things happen before refinery or any project gets built.

Let dangote just take it to either tanzania or uganda if kenyans don't want the refinery in their land.

Jealousy is the word.

Kenyans, South Africans and Ghanaians appear to be uncontrollably envious of Nigerians. The only reason the Kenyans resist the refinery is that the owner is a Nigerian and they think that Nigerians want to take over their country.

Ethnicity, religion and tribalism truly is a big issue with Africans.

Dangote paid 100 MILLION dollars to Lagos state for the land used for the refinery.

Lagos had earlier paid compensation to the land owners for the Lekki free zone where the refinery dey.

If nothing had been paid, dangote refinery would still be under construction for Lagos, because of the plenty lawsuits that would strike.

Kenya has never had a subsidy on fuel. Fuel prices have always been high there.

Infact, most African countries have had high fuel price for decades since independence. Dangote refinery may even cause a slight reduction in price self, because Kenya imports fuel from the Middle east.

You are assuming that person understands the dynamics of fuel price vis a vis subsidy, to understand that removal of the subsidy was why the fuel prices shot up. It appears he clearly simply believes fuel prices shot up because Dangote built a refinery. I wouldn't waste my time with that kind if I were you.

Who do you wetin? If it was a Kenyan that owned the project, maybe I would see it as backwardness but it's owned by a foreigner. Do you know how many hectares they'll cede to Dangote for the refinery?

Ask yourself... If a Kenyan was doing the same in Nigeria, will every local be happy with it?

Capitalists will never do anything for the good of the people. Their profit overrides your welfare anytime any day. It's up to you as the masses to see if what you'll be benefitting outweighs what you will be sacrificing.

They understood it doesn't make a difference. Charity they say starts at home. If Dangote hasn't made any difference here in Nigeria what is the assurance it will help the cause of Kenyans?

Dangote and the Kenyan Govt should settle the farmers and landowners well

They have a right to their property, taking it from them should come with adequate compensations

The people are not stopping Dangote, they want the right thing done

You wey dey talk "Who do us this thing", if Dangote take your papa land without adequate compensation, will you be happy?

or you think all Africans are like Nigerians that don't know their rights?

If Dangote build a refinery in Kenya
Fuel will be unreachable for their masses

Just like he did to cement and petrol in Nigeria

As long it may seems like a bad news, or that the people opposing are dumb,

The quote should also be considered if their complaint is genuine.

It is very wrong evicting a people without a relocation plan, irrespective of the benefits the reason for the eviction will serve.
