A Lagos-based lawyer, Ebun-Olu Adegboruwa, has
asked a Federal High Court in Lagos to stop the monthly
environmental sanitation in Lagos State.
The lawyer is asking the court to declare as illegal, the
monthly exercise, during which citizens’ movements are
restricted.
He joined as respondents in the suit the Inspector
General of Police, the Lagos State Commissioner of
Police, the Lagos State Governor, the state’s Attorney
General and Commissioner for Justice.
Others are the Lagos State Commissioner for the
Environment and the Ministry of the Environment.
The applicant in his motion on notice argued that the
imposed environmental sanitation on every last Saturday
of the month did not have any legal backing.
According to him, the restriction of people’s movement
is in conflict with sections 35 and 41 of the constitution,
which guarantee rights to personal liberty and freedom
of movement.
Adegboruwa stated that the restriction also violates
Article XII of the African Charter on Human and Peoples’
Rights (Ratification and Enforcement) Act, Laws of the
Federation of Nigeria, 2004.
He is therefore asking the court to declare that the
Lagos State Government and its agents do not have the
legal backing to restrict movement of Lagos residents
on the last Saturday of the month.
The applicant is also asking the court to declare that the
respondents can not, as of right, arrest and detain any
Lagos residents found moving on either state or Federal
Government roads in the state on the last Saturday of
every month.
Justice M.B. Idris has adjourned till January 28, 2015 for
hearing of the suit.

What's difficult there to take propare cleaning the state and enviro once a month.

Just because it disturb your functions now that you the state to suffer from communicable diseases.

In my village Ezere in Awgu L.G.A Enugu state the chairman of the local government still harrass and intimidate the villagers to sweep the court room, when they fail to do he uses police to intimidate them, his name is Manthanus Nnanna chairman Awgu L.G.A. my question is what has happened to the cleaners the government should hv employed to do the work?

Do you need a law to force you to clean your environment once a month? How can you force everyone to clean their environment at the same time? are we living in a communist country? In sane societies environmental hygiene is the responsibility of individual citizen and environmental standards and codes are enforced by law enforcement officers. The idea is to make sure your environment are clean always and not just one day a month.

The restriction of movement by force is against our fundamental right of free movement as enshrined in the constitution.
