But a court has ruled that there is no division in PDP.

during that period, yes there was none. but the preceding divisions were enough legal grounds for him to defect. remember that his defection has been mentioned continually by the media for months and was no a sudden decision

seriously dude... Besides the constitution goes on to say that even in the even in the event of such a legislator's removal such a removal can only be made by the presiding officer, who in this case also happens to be the defecting party. Also removing a legislator from the house will deny his constituents representation in the chamber pending the time for reelection. time which in Nigerian politricks may take up to a year...
so before you start bandying blindly and ignorantly and also throwing insults you should actually make sure that you have a point to stress

They may not be the party involved but they as Tumbuwal constituents have right of representation cos Tumbuwal is not speaker on his capacity but on the vote and supposed confidence place on him by his constituents. Now it follows that if he Tumbuwal has interest that excludes those who elected him then his problems just started

So also should Mimiko and every APGA member in Anambra state elected into the house and the House of Assembly members in Ekiti State and Ogun State and every other political officer who have ever decamped without division in their respective parties. are you not making noise about those? Or is the law effective only for those who left PDP and not those who joined? If no double standards are in place that should be the case. But I guess you won't agree, would you?

I wonder why the affected constituency was denied the opportunity to be joined when they have sufficient interest in the suit. But then again, if they have not been joined,do they have the locus standi to bring an application for stay of proceedings when they are not a party before the court?

There is no doubt that they have a right of appeal against the ruling of the court but whether the proceedings of the court should be stayed is another matter entirely. I think it will boil down to whether the court considers them a necessary party or not. Judging by the refusal of their application to be joined, the court doesn't consider them a necessary or even desirable party.
Thus I don't see how the court can allow their motion for stay of proceedings. To do so would be to Approbate and reprobate in a way. Why grant a stay of proceedings to someone whom you think is not necessary to the case in the first place. They have a better chance of getting the stay at the court of appeal.

I totally agree with you but on the other hand, don't you think that such interlocutary appeal against the ruling of the court should ordinarily act as a stay at the lower court?
