Please I need to know what sort of documents are required or should be requested for when purchasing a terrace house in a compound of 4 units. My friend is about to buy 1 unit in a compound of 4 units and I dont want him to get scammed, also who doesn't the documentation for the purchase? Is it the Seller or the buyer?

LeMme advice you as an estate surveyor that i am...Get a lwayer or registered estate surveyor to investigate the house and title,,u wud pay a lil professional fees,but they are the surest bet.

First of all, you should request for the following documents:

Approved building plan. This is to ensure that what you are buying is not a building running foul of building regulations which would make the new owner directly liable for sanctions which could include demolition of the property.

Title of the Seller. This is the most important information to obtain and investigate. Whether a C of O, a Gazette, Governor's Consent, Registered Conveyance or any other, it must be thoroughly investigated. You wouldn't want to buy a beautiful apartment built on a land earmarked by the Government for a market.

Estate Covenants. It is important to read and understand this thoroughly as it could embody conditions subsequent to ownership and occupancy of the property. E.g extra fees, maintenance, curfews, etc.

Deed of Assignment. This is usually prepared by the buyer's lawyer. If the seller insists on his own lawyer preparing it, your lawyer MUST read the document and inform you of the terms before you sign. This is very important as there have been instances of unscrupulous sellers inserting clauses that give rise to litigation.

Purchase Receipt. Also very important. It is the evidence of payment for the land. If Shoprite can give you receipt for a loaf of bread, your seller should also give you receipt for what he is selling.
