The Chief Prosecutor of the International Criminal Court, Fatou Bensouda, stated that only nationals of ICC member states could be investigated and prosecuted for crimes covered under the Rome Statute. The United States has "signed" the treaty, but have not yet ratified it; hence the country isn't qualified as a member state. The Rome Statute of 1998 established the ICC and its subject-matter jurisdiction: genocide, crimes against humanity, war crimes, and the crime of aggression.
