There have been several opinions on the sentence given to the ex-governor of Jigawa State and his two sons on Thursday 9th July, 2015 and I have seen reasons to go with those who believe the ex-governor was been victimise. The purpose of this post is to examine some of the issues raise by those oppose or for the harsh sentence given to the trio.

Precedence: Prior to the sentence, several court cases of like nature have been given on which the trial judges gave options of fine for bail conditions. A recent one was the case of Ohakin (Imo State ex-governor), Nyako (a day after case), among several others. It would have been okay seeing the nature of the case involving him and his sons for the trial judge to give similar judgement. Based on recognition, trial judges have given fair sentence (bail applications) on many cases with the directive to seize the travelling documents of such individuals. It may not be out of place for same to the given in this case. Another point of consideration is the duration of time for the bail application to be heard (September - which is 3 Months time). This too is not fair for any human.

Developmental Projects:

Another area of consideration is the level of development and transformation witnessed in Jigawa State during the 8 Years rule of Sule Lamido. Before now, Dutse (the State Capital) was a small town with no form of infrastructural presence. I could still recall vividly the time I spent in that State (vis a vis Kano State) from 2007/08, apart from New World FM (Radio Station on top of a rock), the State House (very poor too) and few other places, one can not really tell if Dutse was a State capital or not. The coming of Sule Lamido not only brought great dividends of democracy but also open the State to all forms of development. This range from a brand new International Airport to massive Real Estate development (Housing Estates all over the capital and other major towns in the State. It will be out of place for one not to acknowledge the giant stride of development brought by Sule Lamido to Jigawa State. The reason for this is that, though if culpable, the law should take its course but the manner he and his sons were denied bail application till 3 Months time is a rape of the true application of the Rule of Law.

There are many States today where their chief executives rape the States to the last kobo yet no form of development. These individuals still walk free without any form of harassment, if what is good for one should be good for all, I strongly opined that the trial judge should reconsider this case and grant the bail application in no distant time (Next Week). In spite of some of the absurdity on contract inflation or awarding such to a godfather in State like Lagos, Ogun, Osun, Kano, Rivers, Delta, Abia, Sokoto, Akwa Ibom, etc., I very much believe many will protest if some of those ex-State governors were given such sentence.

My Plea:
I sincerely wish to ask for the right thing to be done without any form of victimisation. If he is culpable, at the right time, he can be sentence to serve his term and not such a harsh sentence. I plead with the trial judge to reconsider this case. I also call on all well meaning Nigerians to see reasons to prevail on the trial judge to do the right thing without party sentiments.

Thanks for the insult. Read the article again please. It's not the issue of going to jail here but keeping to the precept of the Rule of Law. Where have you read bail application was extended to 3 Months? This is just a wrong judgement. Be humane for once. God bless.

Guy for get that thing, I have heard of a guy languishing in jail for years just because a politician wanted his girlfriend ! And when he was to be released he was rearaigned for armed robbery alledgedly committed while he was in prison. There are thousand of such cases of misplaced justice in our prisons. So please let a politian or two taste the inherent contradiction in our judiciary, and perhaps judicial reforms may speed up

We are all saying the same thing. This is injustice in whichever form. Judicial reform is needed that for sure. This should be a test case for such. Imagine having a father and his sons in detention for 3 good Months. It's not fair.

This issue I am questioning is the length of the bail - 3 Months. That's pure wickedness. While others are been granted bail, he was singled out to stay 3 Months behind bars. It's inhuman in this case.

The judge was obviously angry and took it on him. If u read the report properly u should have seen it there that it is not as if he was denied bail, but the Judge did not even hear the bail application. She said she was ordered to the case by fiat and that another Judge will be assigned to the case to hear the bail application.

But unfortunately for Mr Accused and his other Accusees, the courts are on vacation till September.

Therefore there was no other way than for him to be remanded in prison till his bail application is considered by the court. I think EFCC also contributed to his woes by saying he can not be appropriately detained at their facility.

All the other commendations you wrote about him does not stand any legal advantage if he is found guilty of illegally receiving kickbacks from govt contracts. He will still be sent to jail without any sentiments.

If it is in China, he may even be sentenced to death.

As clear a case of injustice as you'll find anywhere. It's like we now practise "guilty until proven innocent". How can someone apply for bail and you fix hearing for the bail in three months time! The govt prosecutors requested for time to study the bail application and the judge adjourned until September! If the bail application was deliberated upon, and he was denied bail, that's a different case altogether and totally understandable. Then we can say it's a case of awaiting trial. But to lock someone up (who has not been found guilty of anything) for 3 months!

What if at the end of the trial he's found innocent? The most disappointing thing about this case is the comments by so-called progressives. Can one be selective in their "progressiveness"? When has it become ok to fight injustice with injustice?

There were cases on Friday too. It's just wickedness on the part of the trial judge. This is evil of man unto man. Also, I never said he's innocent but only highlighted that the due process of the law should be followed.

I suppose you have never been to Jigawa State. Pre-his tenure, Dutse was like a village but he raised the not only Dutse but many towns in the State to modern cities. But for the media hype, Sule Lamido worked far better than your RBF. A visit to Jigawa State will convince you. Thanks.
