For lawyers in the house, kindly avail me with any section of the 1999 constitution that empowers the President to appoint a chairman for the INEC in acting capacity without the requisite parliamatery approval. If such a section exists did it set a maximum duration where such an INEC boss can act? |

The president can appoint INEC chairman but the person remain acting pending confirmation from NASS. I stand to be corrected though |

No it does not, that is political interference. I hope PDP knows this. |
Re: Does The Law Empower The President To Appoint An Acting INEC Boss? by IsraeliAIRFORCE: 7:48am On Jul 17, 2015 |
It is only Professor Jega that was constitutional mandated to appoint acting INEC chairman and not Mr President. On this note, Prof. Jega appointed five different acting chairmen at different times when he was away from Nigeria to oversee the activities of the agency. All these times there was no time President Jonathan interfered. For President Buhari to appoint INEC Chairman and commissioners, there are process to follow which he didn't follow but rather chose to sack a commissioner whose tenor never ended and as far as this decision remains, it is null and void and of no effect whatsoever. I will be back 2 Likes 1 Share |

chukwudi44: I suspect that and also that Buhari might opt for a Northerner to ocupy that position wen it is suppose to go south. A Northerner just completed a tenure. He might go southwest as with all his appointment. |
Re: Does The Law Empower The President To Appoint An Acting INEC Boss? by Nobody: 7:57am On Jul 17, 2015 |
empireSOM: The question is not even whether the ag INEC boss is a southerner or northerner but whether Buhari had any powers under the 1999 constitution to overule Jega's handover and appoint an ag INEC boss without getting the requisite approval from the NASS |
Re: Does The Law Empower The President To Appoint An Acting INEC Boss? by empireSOM: 7:59am On Jul 17, 2015 |
chukwudi44: This is the part where APC is faster than PDP, they would have made noise and propaganda out of it. See how PDP just they watch, no court case or propaganda. I guess Buhari does not have that power but it is up to PDP to challenge it in court. |

empireSOM: If it was wrong, PDP would have shouted. They know most of these more than us. Oppositions fight with everything at their disposal. I think this is not one of those things that are unconstitutional. |

Re: Does The Law Empower The President To Appoint An Acting INEC Boss? by IsraeliAIRFORCE: 8:10am On Jul 17, 2015 |
MzJackBaueress: Thank you for seeking clarification. The President has no right to appoint acting INEC Chairman. The law allows INEC Chairman to appoint Acting Chairman without presidential interference. A notable constitutional amendment was also made to insulate INEC from the control of the President of the federation in running its affairs. 4 Likes 1 Share |

Una go die for nothing! Pmb would appoint anybody he feels like and the only thing u tandriods can do is wail as usual. PDP had the opportunity to remove this power from the presidency but they thought the would rule for 60 years as sure no need. Its payback time and Nigerian have no sympathy for the devilish party. 1 Like |
