Does The Law Empower The President To Appoint An Acting INEC Boss? by Nobody: 7:17am On Jul 17, 2015
For lawyers in the house,kindly avail me with any section of the 1999 constitution that empowers the President to appoint a chairman for the INEC in acting capacity without the requisite parliamatery approval.If such a section exists did it set a maximum duration where such an INEC boss can act?

The president can appoint INEC chairman but the person remain acting pending confirmation from NASS. I stand to be corrected though

PDP and other parties would indeed do the needful should the need arise.I just want to believe PDP are waiting till July 21st when Zakaria's tenure @ INEC elapses to see what PMB will do before taking any further action

It is only Professor Jega that was constitutional mandated to appoint acting INEC chairman and not Mr President.

On this note, Prof. Jega appointed five different acting chairmen at different times when he was away from Nigeria to oversee the activities of the agency. All these times there was no time President Jonathan interfered.

For President Buhari to appoint INEC Chairman and commissioners, there are process to follow which he didn't follow but rather chose to sack a commissioner whose tenor never ended and as far as this decision remains, it is null and void and of no effect whatsoever.

Seriously I wonder why the case is not yet in court.My guess is maybe because the next elections are still months away and Zakaria's tenure would elpase in a few days time

I suspect that and also that Buhari might opt for a Northerner to ocupy that position wen it is suppose to go south. A Northerner just completed a tenure. He might go southwest as with all his appointment.

Thank you for seeking clarification.

The President has no right to appoint acting INEC Chairman.

The law allows INEC Chairman to appoint Acting Chairman without presidential interference.

A notable constitutional amendment was also made to insulate INEC from the control of the President of the federation in running its affairs.


Like any other independent body created under the Constitution, INEC had the power to issue rules β€œto regulate its own procedure or confer powers and impose duties on any officer or authority for the purpose of discharging its functions.” To do so, however, it needed presidential approval previously.

The need for presidential
approval was eliminated by constitutional amendment, giving INEC absolute power to regulate itself for the purpose of carrying out its functions.

PDP had the opportunity to remove this power from the presidency but they thought the would rule for 60 years as sure no need. Its payback time and Nigerian have no sympathy for the devilish party. cry
