The election of a Peoples Democratic Party senator, Bashir Marafa, representing Taraba Central Senatorial district has been nullified by the election tribunal in Jalingo, Taraba state.

In a ruling today, the tribunal ordered that the candidate of the All progressives Congress (APC), Yusuf A Yusuf to be given the Certificate of Return as the lawful winner of the April 2015 election.

Why dont you mumu first educate me by posting links of any legislator,Governor etc who stepped down when the tribunal first ruled against them?

Prior to now the appeal court has been the final court of arbitration for Governorship and senatorial election petition but the constitution was was recently amended making the supreme court the final court for all the cases!!

It ends at the Appeal Court. It's ONLY presidential election case that can get to Supreme court.

the court of appeal decision is final with regards 2 senators and reps member. Bt supreme Court is final court with regards 2 gubernatorial and presidential elections

Chukwudi is partly correct. If the PDP guy appeal, the appeal court may grant stay of execution pending determination of the suit.
However, this days, appeal court is very fast. In one to two months appeal court decision will be made. The PDP guy may appeal again at the supreme court. This may take another 3 months.

The PDP senator may still remain a senator for another 6 months.

However, the PDP senator is a goner. I dont see any chance that apeal and supreme court will reverse the decision of the tribunal in this case.

I didn't want to get involved formerly but your naivety calls for calm. Until a new judgement is delivered, the judgement from the tribunal holds till the supposed period of occupancy of the office. The APC senator would be sworn in no distant time as long as the certificate to be issued is Available. Just like GEJ never pursued his case, the PDP senator might wish not to go further in court ordeals and accept the ruling, moreover, the judgement has being served to his lawyers. Until the judgment is annulled, the PDP senator ceases to hold office. When Osunbor was removed in Edo, the last judgment of a higher court overrides that of the lower and until there is another judgment just like as I said from another higher statutory court, the last judgement holds.

Is the appeal court the final court of arbitration for senatorial cases? I know the constitution was recently amended taking the final arbitration for Governorship election cases to the supreme court,I had assumed the same thing applied to the senatorial seats!! It would be strange if the senators who carried out the amendment wouild leave out their own cases and amend only that of the Governors.

Mr Lawyer stop blowing grammar and post a link to show me where Oshiomhole was sworn in as Governor before the appeal court validated the election tribunal Judgement sacking Osunbor!!! Unless the senator choses not to appeal(which me and you know is possible) he will remain in the senate until the final court of arbitration rules on the matter.

The supreme has no say in this matter. Election cases end at appeal court.

Senatorial and Rep Election issue do not go beyond appeal Court only Governorship and Presidential goes to Supreme Court.
