Prior to now the appeal court has been the final court of arbitration for Governorship and senatorial election petition but the constitution was was recently amended making the supreme court the final court for all the cases!!

@Chuckwudi44 Sir, Senator Marafa will vacate (has vacated) the seat by the pronouncement of the tribunal. His appeal will be from outside. He can only remain when Appeal Court grants 'stay of Execution' but the court no longer grant such. On July 26, election tribunal sacked APC Lawmaker representing Etsako West II in Edo state House of Assembly. He has vacated his seat and the winner of the tribunal Sylvanus Eriagha of PDP was immediately sworn-in.

Are you serious? A copy of the ruling will be sent to the senate. The court order must be enforced immediately pending appeal. He may pursue his case at a higher court but not as a sitting senator. Its like when court ordered NDLEA to vacate the premesis of Buruju Kasumu, you have to vacate the premises pending your appeal at a higher court. Its also like when a court says "Discharged and acquitted", the prisoner has to become a free man immediately pending appeal of the ruling.

I dont like long stories!! Senator Marafa's election is not the first senatorial election to be annulled under the 4th republic!!! I need you people to back up your claims with appropriate links from 1999-date where any senator lost his seat immediately the election petition tribunal ruled against him without waiting to hear the judgement of the appeal court.

Bro, leave this long argument. How do you know whether or not apc didn't appeal? No Appeal Court has validated the trial court judgement.

Sorry, you got it mixed up. The Appeal Court is not required by law to validate any judgement of a lower court or tribunal. The Appeal Court only makes judgement WHENEVER any party to a judgement files an appeal to it. The judgement of an Appellate Court can either be to AFFIRM the ruling of the lower court or DISCHARGE the ruling of the lower court.

Now the subsisting judgement is that the PDP guy vacates, that is the only judgement to be enforced EXCEPT if the Appeal Court decides that it will issue a Stay of Execution but in the last quarter of 2015, the SC had directed that such should not be issued on electoral matters again as there is nothing injurious to be suffered during the appeal process.

I know the constitution was recently amended taking the final arbitration for Governorship election cases to the supreme court,I had assumed the same thing applied to the senatorial seats!! It would be strange if the senators who carried out the amendment wouild leave out their own cases and amend only that of the Governors.

That's exactly how several of the PDP sinators supporting corruption will be thrown off in the coming weeks. Trust this prediction. 90% of these sinators stole someone else's mandate.
