obviously, PMB and CJN does not like the judgement...they want the judgement to go certain way ..which it did not and so had to do this .... back to OBJ days of Judicial manipulations...maybe that is how the military operates ..... PMB will lead Nigeria to disintegration very soon...... FEC meeting diid not hold ....hmmmn...yet this Lagos Ibadan press are silent about it...... |

They initial stay of proceedings was pending the outcome of saraki's motion filed at the FHC questioning the CCT's authority and its members constitution. That was delivered this week, and so it just makes the reconstitution of another panel by the CJN more in order. I was particularly irked by Justice John Fabiyi's panel decision until I read what Mike Ozekhome was saying, concerning the courts. I will agree with Prof. Itse Sagay and Falana on this one, you cannot put a stay of proceedings on a criminal charge like this one. "Does a similar thing" is used in the context of the judgment not going the way you and the Punch would seem to prefer, i.e. that Saraki is hurt by 'fire and brimstone'. What if he was not convicted as you people are seemingly trying to predetermine? Your argument on the New Administrative Law on stay of precedings is neither here nor there. Some other senior lawyers have argued differently. For every 'compromised' River State electoral tribunal chairman that was changed by the NJC, there is a Yobe State electoral tribunal chairman that is untouched/untouchable by the NJC. You don't determine anyone's history. History is perception. It's subjective, it depends on who is writing it. Someone's hero is another person's villain. A former chief justice who gave James Ibori a clean bill of health despite a glaring evidence that he was previously convicted is now enjoying a blissful romance with the 'progressives'. |

When he accepted to declare a candidate of acn in one of the south west states (I think osun or oyo) winner through the back door by accepting 10million dollars bribe. The panel is being reconstituted because it's judgement cannot be allowed to stand, because it is an illegality and it portends danger for our justice system. The New Administrative Law of stay of proceedings represents a great progress in our justice system, that is corrupt politicians will no longer be able to use that weakness to prolong their trial which runs into several years until the government gets tired. The case of Abachas son went for over ten years due to various interlocutory injunctions and all sorts. This ruling by the supreme court takes all that away in one stride and take things backwards to like 10 to 15 years ago. |

bonechamberlain:No, I'm not saying so; the Chief Justice of Nigeria is saying so, after several learned lawyers and SANS like Femi Falana etc. raised alarm over the issue and the danger it portends for our justice system if allowed to subsist. Make no mistake about it, the goal of the CJN is to upturn the ruling. Why else would CJN be going through the trouble of reconstituting another panel? It's not about Saraki, it's about safeguarding the entire justice system. If the ruling or grant is allowed to stay, by precedent it become part of law, which many future cases will continue exploiting. This is the Supreme Court and not and High court. The decision to disband the panel, according to judiciary sources, is partly due to the outcry generated by the Supreme Court’s ruling and the imminent retirement of Justice Fabiyi from the bench on November 25. Eminent lawyers, including Prof. Itse Sagay (SAN), Chief Folake Solanke (SAN), Chief Adegboyega Awomolo (SAN), Mr. Femi Falana (SAN), Jiti Ogunye and Malachy Ugwummadu, had described the Supreme Court’s ruling as contravening provisions of sections 306 and 369 of the new Administration of Criminal Justice Act. The ACJA prohibits granting of a stay of proceedings in criminal cases. |

lanrefront1:. let us be careful in this country, remember its the supreme Court we are talking about, if the cries of "eminent lawyers", can make the cjn to disband a legally constituted panel, then we are in trouble, cause any govt can come into power and get some "eminent lawyers" on its side asking them to cry out loud on any case that doesn't favour the govt, thereby putting pressure on the cjn to form another or reconstitute the panel. we should not be playing politics with the judiciary especially at the highest level " the supreme Court". |

I think you read the article and see the reasons the CJN stated for taking the action it is taking . And it is exactly because it's the Supreme Court we are talking about, that the CJN cannot allow the ruling to subsist without upturning it. Don't you get that?
