WHAT NEXT FOR KOGI STATE.

There is a constitutional crisis brewing in the country with regards to the elections in Kogi state with the sudden death of Prince Abubakar Audu the APC Governorship candidate in the November 21 elections in Kogi State. The APC governorship candidate who died suddenly on Sunday by 5am before INEC started collating results from LGAs

The APC knew about these, but decided to keep it a secret in hope of them being declared winner which will make it ...easy for Audu’s deputy to take his place.The constitution is very clear in its provisions with regards to such an event occurring in the country, but one thing the constitution did not envisage was a candidate death and the elections inconclusive.Although INEC announced most of the results, it also declared the election inconclusive because the number of cancelled votes was higher than the vote difference between the first and second placed candidates.


In other words, the number of cancelled votes is enough to determine the winner. Audu secured 240,867 votes, while Idris polled 199,514 votes. The difference is 41,353, and the cancelled votes were 49,953.

Section 181(1)States ‘ if a person duly elected as Governor dies before taking and subscribing the oath of Allegiance and oath of office,or is unable for any reason whatsoever to be sworn in,the elected with him as Deputy Governor shall be sworn in as Governor and he shall nominate a new Deputy-Governor who shall be appointed by the Governor with the approval of a simple majority of House of Assembly of the state’.

The issue in Kogi is very peculiar as regards to the fact as earlier mentioned,no one was declared winner in the election.The electoral body came out with an inconclusive result

One thing is very pivotal,votes casted in an elections can not be given or awarded to the dead,In my opinion Wada the second runner up in the elections should be declared winner outrightly.

logically and constitutionally i think i agree with you because since the leading candidate died, the second runner up is suppose to be announced as the winner which is Wada, the incumbent governor of Kogi state. #KogoDecides

the kogi case reiterates the statement 'those who live in glass houses should not throw stones. the issue has been linked also to the Amaechi and Atiku's cases in the past. those cases might have been handled then just to suite some particular people, now can those same people want the outcome here to follow same path? another thinking am having now is that with reports claiming that Audu died hours even before the election process started on the said day, i think that goes to say APC did not have a Candidate in that election(as the tribunal said regarding Gov. Darius's case in taraba) hence the next candidate with the highest vote becomes the winner. But if the news about the resurected Audu is true, that makes it easier for all of us #kogidecides

The APC keeping quiet about it initially can be likened to what happened when President Yar'Adua passed on. I strongly believe the APC wanted INEC to declare Prince Audu Abubakar winner 1st so his deputy would become Governor. It's all scheming!

Let's wait and see if the people of Kogi will vote for a man who rose from the dead, that's if the news i'm hearing right now is true.

With the present situation in kogi state, and in accordance to constitutional law, coupled with our electoral acts, the election is abruptly inconclusive, and what this tantamount is Wada be declared winner of the election. Condolence to the family, Nigeria, APC and Nigeria's Democracy.
