The reason for the election being inconclusive is because the number of votes apc leads pdp is not more than the number of invalid or cancelled votes.

Taraba state on my mind! Why should tribunal remove an elected governor under a recognised and registered party on charges of not being the party's candidate. Since we vote for parties and not candidates, the party should have the right to select whoever to represent it!

You are right in a certain way, however, do not forget that the contestant is dead. So that voids the votes . If INEC and AGF is allowing for substitution, then there should be fresh polls and if INEC cannot do that, then they let Faleke continue but that also is another loophole because he didn't contest in the primaries and where that is not workable, you declare the next contestant with the highest votes the winner. You can't take from Peter and use to pay Paul. To conclusive grounds, the contestant has to be alive.

We keep complaining bout impunity but i have never seen so much impunity like the present administration that keep bending and bending the rules to their favour. Defending and adjusting the rules in such way that the ruling party is favored. This isn't democracy at all.

Now they claim to pick the Audu son. When the electoral act is clear who can participate. So if Audu son is considered, how is it different from Taraba? A consensus candidate won but was upturned because APC claims PDP didn't conduct primaries...

Nigerians should stop being sentimental but stand objectively to promote and protect our democracy so that the path we follow now won't be a serious setback in times to come...

U cant blame apc. The igalas where audu come from are muslims, they have highest number of registered voters. And faleke is a xtian and yoruba. That is why it is very tight for apc.

INEC had declared the election inconclusive on the grounds that cancelled votes or registered voters in the 91 polling units, where the exercise did not take place were 49 953, a figure higher than Audu’s lead of 41,353 votes.

Wada is therefore praying the court to declare him winner on the claim that he is the candidate with the highest number of votes alive.

According to sources privy to the court action, Wada is arguing that the difference in votes between him and Philip Salawu, the Labour Party candidate is more than 49 000 and as such there should be no supplementary election.

Wada, it was further gathered, argued that INEC would not have considered a supplementary or a re-run election had it been that it was the candidate that took third or fourth that died.

Clicksis, truth be told. It is not bout being a loyalist or not. You can't say one thing for A and then go to B and do another thing because of conflict of interest.

If ur logic is anything to go by. Why is it that when those candidates fielded by the parties, crosses carpets, they stil retain the mandates they obtained under the party? Since it is the party's manifesto and not the candidates credibility that is being voted. Why wouldn't the candidates relinquish the mandates they obtaine under their parties when decamping? Just answers my freind. Let us not make our law an ass. Or a tool for intimidation.

Since the mandate/ticket belongs to the party, why didn't amechi,kwankwaso,etc step down after decamping.

It doesn't make statistical or mathematical sense. Kogi had about 1M registered voters of which about 530k got accredited. The ratio of the latter to the former will give a fair reflection of amount of accredited voters out of a possible 49k in those wards that were cancelled. To add to that, how many people with card readers always end up going to vote? Still less than the stipulated number. So in any angle, you won't even get close to 25k let alone 38k.

In Taraba APC proved that PDP had NO candidate for the elections. It put the PDPs garnered votes as a waste because 2 things must be present for elections to hold.
1) a Party
2) the candidate.

They are not mutually exclusive.

If the PDP participated without a candidate, then it is as if they weren't permitted to even garner any amount of votes and as such Darius lost his mandate (according to the Tribunal).

In the case of Kogi, Audu already participated in the elections so his garnered votes cannot be ruled null and void except the PDP can prove he was not qualified to vie for the position. His death cannot nullify his votes either because death only comes into play if he died pre-elections. In this case he didn't.

The so-called Lacuna was created by INEC themselves when they wrongly declared the elections inconclusive. So if APC has any case whatsoever, they should be arguing to the courts that Audu should have been declared the outright winner of the elections and as such his Deputy should be sworn in. APC can now raise someone else (perhaps Audu's son) to be the Deputy governor.

Firstly,

If going by your words, A party and a candidate are not mutually exclusive and no primaries, how come the state then has house of assembly members that are from pdp cos, I believe those contestants from the state Assemblies were picked at the primaries. Not like one primary from the governorship and another for the state assemblies.

This was an election that took place twice and INEC duly acknowledged Davies and their party stand but judgement was given in favour of APC on mere sentiments.


Never the less, it is still not irrelevant to Kogi case as the same rule applies. Once a party has fallen out via its original candidate, there is not substitute becos even the Deputy didn't contest primaries, not to mention as a gubernatorial candidate, thus can't even take Audu stead. His position to deputise or come in control only becomes active when AUDU IS DECLARED WINNER. In a scenario where it's in conclusive, and the candidate cease to exist, the party has been compromised. That is the legal and rational position but APC party loyalist won't admit that. I bet if it was the other way round, the music will be different.

In the case, the election hasn't ended. All other parties that still have a living candidate should suffice and be allowed to continue. The race is not to the swift but time and chance. When that is done, then anyone who objects can then go to the tribunals or visit the courts. That's the way it should be done

There is already a precedence on this case and it is: Amaechi vs. INEC.

In relaying on Section 221 of the 1999 Constitution, the supreme justices concluded that, votes cast are for the party and not the candidate. And as such, if a candidate dies, the party for whom the vote were cat can elect another eligible candidate to assume those votes and contrary to the Honorable Governor, those votes are not invalid.

Though, one do not like this conclusion, but it is the law of the land; it gives the political parties too much power.

I hope he held to account for the massive looting of state resources that has crippled Kogi in the last 4 years.

It WAS then (8 years ago) the judicial INTERPRETATION of our relevant laws.
