When the same court favoured Ambode of Lagos State on the same matter and verdict, they Supreme Court Justices were upright. |
| Re: [VIDEO] REC Mike Igini Speaks On Supreme Court Judgement On Card Reader by OlujobaSamuel: 9:18pm On Feb 14, 2016 |
this was my response in another thread to a guy trying to defend the supreme court judgment. in every judgment given by a judge, justice must not only be served but must be seen to have been served. A lawyer knows that any day anytime. In this case, it's perceived that the law was interpreted for personal/individual interest and not for justice. Our constitution/law forbids electronic voting which was expressly stated, but it never mentioned electronic process, if we are to include electronic process as part of electronic voting, then we can as well use only pen to start writing our eligible voters id and also use it in drawing our pictures on it. I voiced out this same opinion when that nonsense Appeal Court responsible for Lagos electoral matters cancelled the election petition based on this electronic voting/process. @the non qualified to speak perspective you raised, the speaker is a lawyer according to the report so I wonder where you saw the shame you are making reference to. You can pick a stage in the middle of the process just to satisfy your interpretation(that was what the SC did) , it's either the whole process is faulty since the act in that stage was also included in other stages (electronic registration, printing, verification & accreditation) of the process, then the supreme court is wrong in that regards. NB: they are infallible because they can't be questioned not because they are right because they can never and will never be always right. Judgement was made, Justice was not. |

I do have a major problem with way will react to these supreme court latest judgment. Most APC sympathizers are pained because it didn't go their way while PDP sympathizers are in support of the judgment. However only few( very few) are analyzing the judgment dispassionately. But my fair is this except our electoral acts is amended in conjunction with this constitution, we may end up with one party system like OBJ era come 2019. I will strongly recommend that well meaning Nigeria and PDP( the so called opposition party) should be in the lead to ensure CARD READER is more efficient and enshrine in our constitution. If not APC may laugh last regards the latest supreme court judgment come 2019 and Nigeria may end up being the loser and this will set us back like 50years which we don't pray for. In as much I hate to say this, GEJ lost election basically bcs of the CARD READER. We all know the enormous power of federal might especially as regard the election in this country |
| Re: [VIDEO] REC Mike Igini Speaks On Supreme Court Judgement On Card Reader by Nbote(m): 10:37pm On Feb 14, 2016 |
D simple question is does the Electoral Act recognise the use of the card readers? ?? If not den it's an opportunity to amend it so INEC can get to work and get it right once and for all. Since elections still went on even when the card readers failed during the elections, d card readers cannot b said to b solely relevant then. |

baralatie:inec guidelines cannot supersede the electoral act in anyway but can only supplement it. The electoral act forbids electronic voting and *not electronic process. They are 2different issues, like I said earlier, if electronic process is forbidden as implied by this judgment, then we should also do away with anything computer including registration, and starts writing with a pen on white paper. some decisions are better reconsider as much as possible to understand the consequences of such. |

| Re: [VIDEO] REC Mike Igini Speaks On Supreme Court Judgement On Card Reader by baralatie(m): 10:56pm On Feb 14, 2016 |
OlujobaSamuel:I will suggest you go through the supreme explanation again. The SC made it clear that inec guidelines for election is TOTALLY different from the electoral act as regards the Voter regsister. So if the card reader is NOT the recognised voters register list and inec has powers from the electoral act to fall back onto the voter register in the advent of failure of the card readers at the polling center. It invariably means for litigation as regards an election in the court it is the voter register as enshrined in the electoral act and not the card reader will be the basis of argument for or against |

Dakad:you nailed it man, most times, when we come up with issues, we are either for or against the person involved and not the issue itself. However, I will like to disagree with you on the law/guideline issue, electronic voting was forbidden and not electronic process, you can look up for more of my comments on it. On amending that part of the law, you and I know that it's something difficult to do in this current political atmosphere, so our best bet is to maximize the current law for utmost benefits but some set of people with binding decisions that can't be changed have in their own wisdom decides to pull us back when politicians are even ready to move forward. |

baralatie:I believed all these are covered by the process of accreditation if it's their reason, because for now, no official declaration. 1. All card inserted into the reader must be seen at the database station. 2. there is incidence form for failed authentication I don't think inec is dumb enough not to know the statistics of every trial (failed or successful) that was made on the gadget. the incidence form should be enough to give you a right to the Register in event of reader failure, but throwing the reader to the bin because of their interpretation of the act is wrong and not justifiable. like someone said, I pray we don't have someone like obj on the sit of presidency, because if we do, good bye to any gej/jega legacy. |

From the explanation of Mike Igini, it is obvious that those supreme court judges were ignorant of what they adjudicated upon. What they refered to as manual register was actually electronic register. If the act forbid such register, the entire process should have been cancelled. I agree with the man who said those judges need training. They attended schools when there was no computer. That is why they are used to analog systems. You know how long it took the court to leave type writer for computer print on affidavit. Some of those baba justice dont know how to use computer. How will they even know the difference between manual register and computer or digital register. GOD HELP US. |

OlujobaSamuel:Can you see that you are back to the bane of matter...... a ,you need to have YOUR name on the Voter register first before any other process.it is the voter register that says you are allow to perform your duty! And the SC did not sack the use of the card readers it mainly made it clear that for litigation of electoral dispute.it must be in conformity with the electoral act. Good to read about Gej/jega legacy!but as you can see the APC is not interested in gej unless people and the media clamour hard on continuing positive electoral reforms and credible elections Kogi and bayelsa elections does not put PMB administration in good books! Let us pray this administration will work tirelessly in improving the electoral process and promote peaceful ,credible elections |
| Re: [VIDEO] REC Mike Igini Speaks On Supreme Court Judgement On Card Reader by kpogede77: 12:56am On Feb 15, 2016 |
The process of election also involve phone calls using electronic medium, printing of voters register using electronic medium, the PVC itself is coded electronically too. If these processes are forbidden by the electoral act as claimed by those old fools, then the entire election should have been nullified since the processes involved are electronic based. But they chose to notice only the accreditation process to be electronic whereas even the voters register is also electronic. Because they have collected their own portion of the dollar rain. Mike Igini has deflated their ego by his explanation. The honourable thing for them to do now is to resign. Their thought patern is too miopic for Nigerians to accept. They should resign immediately. |

baralatie:Amen ooo. I have no issues with those parties even though am pro apc to an extent, there is always a line. I just fear for those supreme court rulings, they are sometimes crazyy. Pls kindly get this movie if you haven't watch it, 12Angry Men- death in their minds, life in their hands, it's a 1957 movie but applies to legal event till date. Do you know if the previous female cjn was the cjn during the 2003 or 2007, can't remember exactly which, but I think it should be 2007election, that election would have been cancelled, the vote was splited, with the woman raising a fierce argument against that election and some other justices changed their stand, the cjn simply casted is vote in favor of the election by saying it is in the interest of the public to do so, that it's more costly to cancel that election compared to any other cost that might have been incurred during the election. Like I said earlier, I think they to adjust, that's why I love Obaseki, Esho, Oputa and those in their days, they are radical justices that will not allow you to work/walk into technicalities to get judgment. I hope this administration will address that and those in the parliament will support because they are my 2nd fear after judges. God help us. |
