The court session is confirmed over as the so called masked witnesses did not appear again. Meanwhile journalists, including our crew members were not allowed in the court room. We got a first hand information from our lawyer, Barr. Ifeanyi Ejiofor that they have filed a motion for stay of proceedings, which means that Justice John Tsoho will not be presiding over this very case again,
owing to his compromising stance and previous rulings.

Our leader Nnamdi Kanu came to the court few minutes after judgement was passed, and was later escorted back to the prison.

We were reliably informed by our lawyer, Barrister Ejiofor that the appeal proceedings shall be taking place tomorrow.

Our crew of Biafra Writers/BTV had the opportunity of granting our lawyer a live video interview which will be appearing on BTV shortly.
Final judgement states that the case has been adjourned till 6th of April 2016.
Interview with our legal team is ongoing at the moment and details will be relayed to you shortly via this medium as well

I avoid commenting on political issues as I have zero interest I them. However on issues that pertain to the law I will make a contribution. I personally cannot understand why anyone would file a stay of proceedings at this stage for two reasons; firstly if your client is on administrative bail, delay tactics may make some sense, where however your client is in jail, it makes no sense whatsoever to delay the hearing of the substantive suit unless you believe that the prosecution has an iron clad case or you want to buy time to re strategize ( hopefully not tamper with witnesses)

Under the Criminal justice Act the superior court will ask the motion to be heard in tandem with the substantive suit so the issue of delay will not arise ( if this is the strategy). I believe the lawyer to Kanu has made a serious misjudgment here that the prosecution have seized upon to delay the case - it doesn't hurt them to delay the case because the accused is in effect " doing time" through the back door. A better strategy for the defence would have been to allow the case continue and complete and then use the grounds on which the stay application was made to overturn the ruling of the High Court on appeal.

That is why you are still a learner. The person handling this matter is Chuks Muoma (SAN), he hardly loss a case. If you have been following this matter very well you will understand that they have filed a motion for stay of proceedings, which means that Justice John Tsoho will not be presiding over this very case again, owing to his compromising stance and previous rulings. That's a knockout blow (KO). Let's ignore the smoke and focus on the fire shall we?

A stay of proceedings doesn't in any way indicate the same Judge will no longer handle the case. It merely means that the defence intends to appeal a point of law to a superior court and the defence wants to have the matter stayed (or paused) while it does so. As I pointed out, the Criminal Justice Act says you can't pause substantive proceedings while appealing a point of law. So you can bet your last naira that the courts will refuse the stay (or pause) in proceedings in April. The defence might even appeal that too and on and on it goes. In the meantime, who gains from this pause? The client who is incarcerated? Of course not. It is the prosecution because as far as they are concerned the defendant is already in Jail.

I wouldn't swear by a lawyer just because he is a SAN lol, it's 3-5 year lawyers that do their work for them. Law is not a respecter of persons. If the defendants lawyer thought he had a good case he would proceed to trial immediately. When you see a lawyer bobbing and weaving in this fashion, it means he is hunting for technicality or he is trying to elongate the trial so as to justify his fees because for sure he isn't doing it for free. And while he bobs and weaves he must remember that the State can also get into that game too- all the way up to the Supreme Court. By the time the case is finally heard the defendant has already done the time. Which is why I say - justice delayed is justice denied; the lawyer should get on with his case quickly.

Just to focus your mind - this is where we are. The offence of Treasonable felony is a capital offence which is defined by section 37(1) of the Criminal Code Act as follows; a. Any person who levies war against the state, in order to intimidate or overawe the president or the governor of a state is guilty of treason and is liable to the punishment of death.
b. Any person conspiring with any person, either within or without Nigeria, to levy war against the state with the intent to cause such levying of war as would be treason if committed by a citizen of Nigeria, is guilty of treason and is liable to punishment of death.

There is no bail for a capital offence and at the rate the defence is going, the defendant will be in jail for the next four to five years before the final adjudication of the matter. That to my mind is wrong. Double jeapordy.

May justice prevail. I have no skin in the game.

Do you know why the defence counsel apply for stay of execution? You call it waste of time, but to me, the defense counsel does not want to put his egg in one basket judging by the way the trial judge made a u turn as regards his ruling on witness appearance. Even if the original trial goes on pari passu with the appeal, it will be in the defense counsel's advantage! This is because they can use one stone to kill two birds. If they succeed in the appeal (which they may likely do), the original trial will collapse. So in this sense, the defense counsel was right in suing for stay of execution rather than waiting for the original trial to run its course before starting another appeal process which will also take time.
By the way, I don't think it's true that you don't have interest in the case. No matter how you tried to hide your bias, it clearly shows you want the case to swing to the federal government. I can infer it from your writing.
