The Code of Conduct Tribunal is to rule later today on an application for adjournment by the Senate President, Dr. Bukola Saraki, whose trial on 13 counts of false and anticipatory asset declaration was scheduled to commence today.
The Danladi Umar-led panel of the CCT opted for a stand-down to prepare its ruling after entertaining argument and counter-argument on Saraki’s application.
When proceedings started at about 10.30am on Tuesday, the prosecuting counsel, Mr. Rotimi Jacobs (SAN), infor‎med the tribunal that the matter was on March 24, adjourned till today for trial to commence.
Jacobs told the tribunal that his witness was in court and was ready for trial to commence.
But defence counsel, Mr. Paul Usoro (SAN), urged the tribunal to adjourn the case till a period after the hearing of his client’s motion for stay of proceedings of the CCT which was filed before the Abuja Division of the Court of Appeal only on Monday.
The defence only on Monday filed an appeal and an application for stay of the tribunal’s proceedings before the Court of Appeal against the CCT’s ruling delivered on March 24, 2014, dismissing Saraki’s application challenging the ‎jurisdiction of the CCT to hear the case.
Just this morning, the defence filed and served on the prosecution another motion for stay of proceedings before the tribunal.
Usoro gave the‎ appeal number as CA/A/172C/2016, adding that the appeal court had fixed April 26 for the hearing of his client’s motion for stay of proceedings.

The first prosecution witness against Senator Bukola Saraki who is tried for 13-count charge including false asset declaration has entered the dock.

The witness is a young man in black suit. His identity is yet to be disclosed.

But Saraki’s counsel, Paul Usoro again has asked the court for adjournment but chairman CCT, Justice Umar said he has already ruled on it and asked him to sit down.

But Usoro persisted, arguing that he is coming into the matter for the first time and the lead counsel is not available.

He asked the court to adjourn to enable the lead counsel come in or to enable him take proper instructions to proceed with the case.

Justice Umar said the witness should be allowed to give his evidence, then he can leave cross-examine or wait for the lead counsel to be present.

i just pray usoro did not say all these,how can a lawyer says he has not taken proper instruction before entering appearance in court.are there any body saddled with monotoring the conduct of lawyers at all ?/A SAN cannot be heard saying he does not have proper instructions before appearing in court and he cannot say he cannot continue a matter because of the absence of a lead lawyer.does a SAN needs to be led by any body.
