Udmaster:This order doesn't stop that of the Federal High Court but because it's the requirement of law that only a state judge can swear in a governor, no judge of Abia state will swear in the usurper on the basis of this ruling. A state High Court and the Federal High Court are courts of concurrent jurisdiction. Same level. |

AtlanticBreeze:If you so know law, you should have told us which is superior judgement. The only judgement that can vacate the order of Federal High Court is the Court of Appeal or same court that gave the order in the first place, not court with the same coordinate jurisdiction, anything less is exercise in futility. His lawyers know this but just wish to create confusion where none exist and the law is clear about it. |

Judges in Nigeria are now more confused than ordinary citizens,they do not have total control of their mind and decisions being controlled by the executives.The irony is that from bar they call themselves "Learned" but one wonders how LLB and BL can make one learned,let judges be holders of doctorate degree in Law and all this madness will stop,NBA,NJC,etc should call these judges to order,people are now ridiculing a noble profession because of these greedy judges. |

one of the conditions for the grant of stay of execution is if there is a likelihood of the appeal being won. But for the purposes of fair hearing, most courts grant this order even when it is glaring that the appellant will not win. anyhow, make we dey watch. |

Udmaster:. Please let us stop confusing these things, Federal High Courts and State High Courts are on the same level on the Judicial Hierarchy of Nigeria. The only difference is in their jurisdiction vis a vis what they can adjudicate on respectively. The State High Court is not stopping the execution of the Judgment of the Federal High Court rather tying the hand of those who should execute the judgement pending a decision of a higher court which is the Court of Appeal. On the Stay of Execution, without holding brief for Ikpeazu, I expect that he should have followed the procedure of filing both at Court of Appeal as well as at the Federal High Court simultaneous such that if the latter throws it out, the former may grant it. |
