The employers should be arrested, how will you keep a loaded gun in a room and tell children to clean the room, the owner of the gun and not the little boy should be the one to answer for the crime.

If the picture shown is that of the mother, then she looks like someone having a spiritual problem with that kind of hairstyle, she needs to check herself up and the child called 'MIRACLE'.

What sort of a 'miracle' child is her's? That 7 years old boy should be watched, he looked too bold in that picture with the mother. Hope we are not having another 'Odumegwu Ojukwu' in the making!

My question is was the boy aware why he was arrested? Can he bold tell some one his crime? Is he feeling remorse? Police should arrest the owner of the gun and the elder brother who saw the gun but could not get it out from the kid.

The elder brother might also be a minor. Again, it is better the child is not told that he killed someone because it will be too dangerous for him psychologically. He needs to be cautioned to avoid harmful objects.

But why is nothing said about the owner of the gun?

I suspect that this child is a product of single parenting because nothing was said about his father. Very unfortunate I must say.

A son needs a father and a daughter needs a mother.
In the absence of any of the two in a child's life, the result is mostly dangerous for the society.

Just imagine yourself, a 7yrs old, who barely could distinguish right from wrong, shut in prison for life for just playing with a toy gun which happens to be a real ones, or if you were a father, for ur 7yrs old son to be imprisoned for the aforesaid jail term on the aforesaid circumstances.

It is the position of the law that a 7yrs old can be criminally responsible if it is proved that as at the time he committed the act he had the capacity to appreciate the unlawfulness or wickedness of the act. From the facts of this incident, it is evident that the act was not wickedly, in that he did not walk up to someone maliciously and shoot him. He may be negligent as to what could result from his action ( playing with a real gun), but this does prove intent to kill, since the decease was totally out of view and was only hit by accident. And it is the law that a person cannot be criminally resposible for a event which occurred by accident or for an act which occurred independently of the exercise of the will. Having said that, the boy may still be criminally responsible if, as at the time he committed the crime, it was established that he knew that his act was unlawful. Clearly, this does not apply since the act was an accident. Although he may know that killing someone deliberately is an offence, that presumption is negatived by the fact that he did not intend to kill.

This said, until the case goes to court can it be clearly seen whether the boy is guilty or not. Notwithstanding, he has a presumption of law to his advantage (though rebuttable), in the words: "a child of seven or over and under twelve is incapable of committing an offence"
